HomeMy WebLinkAboutM10142009ON C'O x'11 W'0� IN RISK MANAGEMENT COMMITTEE October 14, 2009 - 9:30 a.m. MINUTES MEMBERS: David Alvarez, Deputy Prosecuting Attorney Philip Morley, County Administrator/Risk Manager Lorna Delaney, Clerk of the Board/Risk Coordinator (Chair) RECORDER: Leslie Locke, Deputy Clerk of the Board Chair Lorna Delaney called the meeting to order at 9:35 a.m. in the presence of Members David Alvarez and Philip Morley. APPROVAL OF MINUTES Member Morley moved to approve the minutes of September 9, 2009 as presented. Member Alvarez seconded the motion which carried by a unanimous vote. EXECUTIVE SESSION The Committee met in Executive Session from 9:35 a.m. to 9:45 a.m. regarding potential litigation. This exemption is outlined in the Open Public Meetings Act RCW 42.30.110(1)(i). At the conclusion of the Executive Session the meeting was reconvened. The committee deliberated and took the following actions. CLAIMS FOR DAMAGES DISCUSSION AND POSSIBLE DECISION Claim No.: C-06-09 Claimant: Mike Belenski Damages: $700.00 Allegation: Violation of State & Federal Rights A letter was sent to Mr. Belenski on September 10, 2009, stating that the permanent injunction is still in place and the mistake was corrected within four (4) days by Community Development staff and asking how he arrived at $700 in damages. No response has been received from the claimant. No action was taken. Decision: Pending Risk Management Committee Meeting Minutes - October 14, 2009 Page: 2 Claim No.: C-09-09 Claimant: George Bigelow Damages: Unknown Allegation: Damage to Property The Committee reviewed the facts relating to this claim. An internal investigation was performed by the Jefferson County Public Works Department. Member Alvarez moved to deny this claim. Member Alvarez moved to direct the clerk to draft a letter to George Bigelow denying payment of #C-09-09 for the County Administrator's signature. Member Morley seconded the motion which carried by a unanimous vote. Decision: Denied Claim No.: C-10-09 Claimant: Shirley Reynolds Damages: $1,248.28 Allegation: Damage to Vehicle The Committee reviewed the details of this claim. Based on an internal investigation confirming the facts as presented to the County by the claimant, the members agreed that the claim should be paid. Member Morley moved to approve payment of claim #C-10-09 submitted by Shirley Reynolds in the amount of $1,248.28. Member Alvarez seconded the motion. Two estimates were submitted by the claimant with the larger one in the amount of $1,526.24. Member Alvarez amended the motion to approve payment of #C-10-09 not to exceed $1,526.24. If the cost to repair exceeds that amount, the Committee will need to approve the additional amount at a future Risk Management Committee meeting. Member Morley seconded the amended motion which carried by a unanimous vote. Member Alvarez moved to direct the clerk to draft a letter to Shirley Reynolds for the County Administrator's signature. Member Morley seconded the motion which carried by a unanimous vote. Decision: Approved NOTICE OF ADJOURNMENT Member Alvarez moved to adjourn the meeting at 9:49 a.m. Member Morley seconded the motion which carried by a unanimous vote.
