SPECIAL MEETING
MINUTES
MEMBERS: David Alvarez, Deputy Prosecuting Attorney
Philip Morley, County Administrator/Risk Manager
Lorna Delaney, Clerk of the Board/Risk Coordinator (Chair)
RECORDER: Leslie Locke, Deputy Clerk of the Board
Member Philip Morley called the meeting to order at 9:35 a.m. in the presence of Member David Alvarez. Chair
Lorna Delaney was absent.
APPROVAL OF MINUTES
Member Alvarez moved to approve the Special Meeting Minutes of November 12, 2009 as presented. Member
Morley seconded the motion. The motion carried.
EXECUTIVE SESSION
The Committee met in Executive Session from 9:35 a.m. to 9:55 a.m. regarding potential litigation. This
exemption is outlined in the Open Public Meetings Act RCW 42.30.110(1)(i). At the conclusion of the
Executive Session the meeting was reconvened. The committee deliberated and took the following actions.
CLAIMS FOR DAMAGES DISCUSSION AND POSSIBLE DECISION
Claim No.: C-06-09
Claimant: Mike Belenski
Damages: $700.00
Allegation: Violation of State & Federal Rights
The Committee reviewed the facts relating to this claim. Member Alvarez contacted Mike Belenski by e-mail.
Mr. Belenski wants some type of acknowledgement that the County violated his constitutional rights. Member
Alvarez moved to send a draft letter and the standard release acknowledging that the County violated Mr.
Belenski's constitutional rights and in exchange the County will pay Mr. Belenski $351.00. Upon receipt of the
signed release form Mr. Belenski, the County will send the letter. Member Morley seconded the motion. A
vote was taken and the motion carried.
Decision: Approved for a lesser amount ($351.00)

Personal Injury
The Committee reviewed the facts relating to this claim. Member Alvarez stated that a settlement offer of
$6,000 was received from the Claimant's attorney. The Washington Counties Risk Pool assigned an adjuster
who investigated the claim and made a recommendation. Member Alvarez moved that he be authorized to
contact the Risk Pool and have them to notify the adjuster to settle this claim for an amount between $5,000 to
$6,000 as recommended. Member Morley seconded the motion. The motion carried.
Decision: Pending
Member Alvarez moved to direct the Clerk to prepare a letter for Mike Belenski that he will receive after he
signs the release form regarding claim #C-06-09. Member Morley seconded the motion. The motion carried.
Member Alvarez moved to authorize himself to send Mike Belenski the draft letter and release form via e-mail.
Member Morley seconded the motion. The motion carried.
NOTICE OF ADJOURNMENT
Member Alvarez moved to adjourn the meeting at 9:58 a.m. Member Morley seconded the motion. The
motion carried.
