HomeMy WebLinkAboutM12092009RISK MANAGEMENT COMMITTEE December 9, 2009 - 9:30 a.m. MINUTES MEMBERS: David Alvarez, Deputy Prosecuting Attorney Philip Morley, County Administrator/Risk Manager Lorna Delaney, Clerk of the Board/Risk Coordinator (Chair) RECORDER: Leslie Locke, Deputy Clerk of the Board Chair Lorna Delaney called the meeting to order at 9:31 a.m. in the presence of Members David Alvarez and Philip Morley. Because Ms. Locke was out of the office at the time of this meeting notes were taken by Chair Lorna Delaney and later memorialized here by Ms. Locke. APPROVAL OF MINUTES Member Morley moved to approve the Special Meeting minutes of November 30, 2009 as presented. Member Alvarez seconded the motion which carried by a unanimous vote. EXECUTIVE SESSION The Committee met in Executive Session from 9:32 a.m. to 9:36 a.m. regarding potential litigation. This exemption is outlined in the Open Public Meetings Act RCW 42.30.110(1)(i). At the conclusion of the Executive Session the meeting was reconvened. The committee deliberated and took the following actions. CLAIMS FOR DAMAGES DISCUSSION AND POSSIBLE DECISION Claim No.: C-06-09 Claimant: Mike Belenski Damages: $700.00 Allegation: Violation of State & Federal Rights Member Alvarez informed the Committee that Mr. Belenski requested additional time to review the settlement letter. The deadline for responding to the County is December 15, 2009. Member Alvarez will follow up. Decision: Pending Risk Management Committee Meeting Minutes - December 9, 2009 Page: 2 Claim No.: C-11-09 Claimant: Katharine Schetterer Damages: $6,000 Allegation: Personal Injury Member Alvarez updated the other Committee members by reporting that the Washington Counties Risk Pool's adjuster settled with Ms. Schetterer for $5,500. The Risk Pool will issue a check and the County will reimburse them. Decision: $5,500 Claim No.: C-13-09 Claimant: Barbara Barlet Damages: $8,296.94 Allegation: Property Damage The Committee reviewed the facts relating to this claim. An internal investigation was performed by the Jefferson County Public Works Department. The investigation found that the tree in question was more than 39 feet from the County road right of way located on private property. It was never within the control or responsibility of Jefferson County. Member Alvarez moved to direct the clerk to draft a letter to Barbara Barlet denying payment of #C-13-09 for the County Administrator's signature. Member Morley seconded the motion which carried by a unanimous vote. Decision: Denied After the Committee exited its Executive Session, a discussion ensued regarding the scope of the Risk Management Committee and reviewing of claims. Member Alvarez would like to discuss a possible change to the Risk Management policy at the next Risk Management Committee meeting (January 13, 2010). He has concerns that he acts as legal counsel and is also a voting member. He would still like to attend the meetings as legal counsel, but he would no longer be a voting member. The Committee needs to review the County's Risk Management policy to determine who could take his place as a voting member and whether the Risk Management Policy would need to be revised to reflect the idea that the Prosecuting Attorney's Office would no longer have a voting representative on this Committee. NOTICE OF ADJOURNMENT Member Morley moved to adjourn the meeting at 9:42 a.m. Member Alvarez seconded the motion which carried by a unanimous vote.
