HomeMy WebLinkAboutM03122008gON C'O �IN RISK MANAGEMENT COMMITTEE March 12, 2008 - 9:30 a.m. MINUTES MEMBERS: David Alvarez, Deputy Prosecuting Attorney Frank Gifford, Temporary Interim County Administrator/Risk Manager Lorna Delaney, Clerk of the Board/Risk Coordinator (Chair) RECORDER: Erin Lundgren, Deputy Clerk of the Board In the absence of Chair Lorna Delaney, Acting -Chair Frank Gifford called the meeting to order at 9:30 a.m. in the presence of Member David Alvarez. EXECUTIVE SESSION The Committee met in Executive Session from 9:31 to 9:45 a.m. regarding potential litigation. This exemption is outlined in the Open Public Meetings Act RCW 42.3 0.11 0(l)(i). CLAIMS FOR DAMAGES DISCUSSION AND POSSIBLE DECISION Claim No.: #C-01-08 Claimant: Russell Trask, c/o Alton B. McFadden, Attorney at Law, Olsen & McFadden, Inc., P.S. Damages: $10,000,000 Allegation: Violation of Civil Rights Member Alvarez made a motion to deny claim for damages #C-01-08 submitted by Russell Trask. Acting - Chair Gifford seconded the motion for discussion. The Committee members concurred that upon reviewing the facts relating to this claim, there is no basis found for the allegation. Acting -Chair Gifford called for a vote on the motion. The motion carried. Decision: Denied Claim No.: #C-02-08 Claimant: William Oskam Damages: $297.74 Allegation: Vehicle Windshield Damage Member Alvarez made a motion to deny claim for damages #C-02-08 submitted by William Oskam. Acting - Chair Gifford seconded the motion for discussion. The Committee members reviewed the facts relating to this claim. According to records from the department of Public Works, sanding operations were being performed by Risk Management Committee Meeting Minutes - March 12, 2008 Page: 2 County personnel on Center Road on the incident date. However, the sanding operation was not performed in a negligent manner by the County employee operating the sanding truck. Additionally, rocks or traction sand material projected upward from the road surface by a tire of a vehicle is a "road hazard" for which the County is not liable. Acting -Chair Gifford called for a vote on the motion. The motion carried. Decision: Denied Claim No.: #C-03-08 Claimant: Florence J. Reeves Damages: $54.15 Allegation: Vehicle Windshield Damage Member Alvarez made a motion to deny claim for damages #C-03-08 submitted by Florence J. Reeves. Acting - Chair Gifford seconded the motion for discussion. The Committee members reviewed the facts relating to this claim. According to records from the department of Public Works, sanding operations were being performed by County personnel on Center Road on the incident date. Acting - Chair Gifford seconded the motion for discussion. The Committee members concurred that upon reviewing the facts relating to this claim, there is no basis found for the allegations. Acting -Chair Gifford called for a vote on the motion. The motion carried. Decision: Denied DIRECTION TO THE CLERK/RECORDER Member Alvarez moved to direct the Clerk to prepare for signature, the claim reports regarding the decision made on each claim. Acting -Chair Gifford seconded the motion. The motion carried. NOTICE OF ADJOURNMENT Acting -Chair Gifford moved to adjourn the meeting at 9:52 a.m. Member Alvarez seconded the motion.
