DAMAGES: $1,300,000.00
ALLEGATION: Loss of Use of Property
DISCUSSION: The facts relating to this claim were reviewed and because this claim for money damages
is now also the subject of a pending lawsuit in Kitsap County Superior Court, it is
determined that the County must deny this claim.

ALLEGATION: Damage to Window of Vehicle
DISCUSSION: Upon reviewing the facts relating to this claim, it is determined that the County was not at
fault. The County -owned vehicle traveling northbound on Center Road that was
pinpointed as the cause of the incident was empty and had been swept clean according to
standard operating procedures. Therefore, the damage and injury the claimant sustained
was caused by others and must be considered the result of an ordinary road hazard not
within the control of the County. Thus, the County must deny this claim.

ALLEGATION: Damage to Buried Underground Service Wire
DISCUSSION: Upon reviewing the facts relating to this claim, it is determined that County records show
that road maintenance personnel were not working in the area where the incident occurred
on the date the claimant alleges the damage occurred. Thus, the County is not liable for
the damages sustained and must deny the claim.
