CLAIM #: C-09-07 - Reconsideration
DAMAGES: $40,417.88
ALLEGATION: False Arrest and Use of Excessive Force
DISCUSSION: The County received a letter (with attachments) dated November 8, 2007 from the
Claimant's attorney requesting the County reconsider its decision of July 3, 2007 to deny
this claim for damages. After further review by the Risk Manager and Prosecuting
Attorney, the Risk Management Committee decided to affirm its earlier denial of this
claim. The arrest of Mr. Barrett on Friday afternoon March 30th caused him to have his
initial appearance at the next available court date, Monday, April 2nd. In sum, there was no
unlawful activity by any Jefferson County employee with respect to the claimant.

DISCUSSION: The Risk Manager and Prosecuting Attorney reviewed this claim for damages. Internal
investigation confirmed the facts as presented to the County by the Claimant. Therefore, it
is recommended that the claim be paid in full.

CLAIMANT: Daniel Ralph Hudson
CLAIM #: C-23-07
DAMAGES: $500,000.00
ALLEGATION: Violation of Civil Rights
DISCUSSION: The Risk Manager and Prosecuting Attorney reviewed this claim for damages. The
claimant's decision to not answer questions during the booking process at the Jefferson
County Jail was the proximate cause of the events he now complains of. Therefore, it is
recommended that the claim be denied.

DAMAGES: $5,000,000.00

DAMAGES: $5,000,000.00
ALLEGATION: Breach of Contract
DISCUSSION: The Risk Manager and Prosecuting Attorney reviewed these two (2) claims for damages.
The validity of the now -challenged plea agreement has been upheld twice by Superior
Court Judges. Therefore, it is recommended that the two (2) claims be denied.
