Barrett CLAIM #: C-09-07 - Reconsideration DAMAGES: $40,417.88 ALLEGATION: False Arrest and Use of Excessive Force DISCUSSION: The County received a letter (with attachments) dated November 8, 2007 from the Claimant's attorney requesting the County reconsider its decision of July 3, 2007 to deny this claim for damages. After further review by the Risk Manager and Prosecuting Attorney, the Risk Management Committee decided to affirm its earlier denial of this claim. The arrest of Mr. Barrett on Friday afternoon March 30th caused him to have his initial appearance at the next available court date, Monday, April 2nd. In sum, there was no unlawful activity by any Jefferson County employee with respect to the claimant. DECISION: Deny Claim CLAIMANT: Bert Loomis, c/o Gendler & Mann, LLP CLAIM #: C-20-07 DAMAGES: $250,000 ALLEGATION: Violations of MPR Code Regarding MERU DISCUSSION: The Risk Manager and Prosecuting Attorney reviewed this claims for damages. It was agreed to table action on this claim pending further investigation. DECISION: Pending Risk Management Committee Minutes - November 15, 2007 Page: 2 CLAIMANT: CLAIM #: DAMAGES: ALLEGATION: Leo Joseph Boyd, II C-22-07 $27.98 Vehicle Tire Damage DISCUSSION: The Risk Manager and Prosecuting Attorney reviewed this claim for damages. Internal investigation confirmed the facts as presented to the County by the Claimant. Therefore, it is recommended that the claim be paid in full. DECISION: Pay Claim CLAIMANT: Daniel Ralph Hudson CLAIM #: C-23-07 DAMAGES: $500,000.00 ALLEGATION: Violation of Civil Rights DISCUSSION: The Risk Manager and Prosecuting Attorney reviewed this claim for damages. The claimant's decision to not answer questions during the booking process at the Jefferson County Jail was the proximate cause of the events he now complains of. Therefore, it is recommended that the claim be denied. DECISION: Deny Claim CLAIMANT: Douglas Eugene Baker CLAIM #: C-24-07 DAMAGES: $5,000,000.00 and CLAIMANT: V. Francie Baker CLAIM #: C-25-07 DAMAGES: $5,000,000.00 ALLEGATION: Breach of Contract DISCUSSION: The Risk Manager and Prosecuting Attorney reviewed these two (2) claims for damages. The validity of the now -challenged plea agreement has been upheld twice by Superior Court Judges. Therefore, it is recommended that the two (2) claims be denied. DECISION: Deny Claims Meeting adjourned.
