DAMAGES:

ALLEGATION: Damage to Electrical Equipment.
DISCUSSION: Upon review of the facts relating to this claim it is recommended that it be denied based on
the finding that no evidence was provided by the claimant to show that the actions of the
County were the proximate cause of the damages sustained. The claimant is also unable to
pinpoint when the allegedly negligent act occurred and thus there is no factual basis for this
claim.

ALLEGATION: Damage to underground service wire.
DISCUSSION: Upon review of the facts relating to this claim it is recommended that it be denied based on
the finding that it is the obligation of the claimant to bury its underground equipment to a
sufficient depth below the level of the roadway.
DECISION: Denied
Discussion ensued regarding the lawsuit filed on behalf of Danny Osmer, Joshua Osmer, and Estelle Giangrosso.
