DISCUSSION: Upon review of the facts relating to this claim it is recommended that it be denied based on the finding that while the Public Works Road Crew was performing brush cutting operations in the area where the incident occurred, the claimant's service line was unmarked not visible to the operator due to vegetation growth. It is the claimant's responsibility to visually mark their equipment to prevent damage to such communication facilities. DECISION: Denied CLAIMANT: Spankie Schmidt, Represented by Philip Talmadge, Attorney at Law CLAIM #: C-2-05 DAMAGES: $100,000.00 ALLEGATION: Failure to Enforce Land Use Ordinances and Failure to Protect Landowners DISCUSSION: The Risk Manager and Deputy Prosecuting Attorney reviewed this claim. It was agreed to table action pending further investigation. DECISION: Pending Meeting adjourned.
