HomeMy WebLinkAboutM09142005RISK MANAGEMENT COMMITTEE MINUTES September 14, 2005 Present: David Alvarez, Deputy Prosecuting Attorney John Fischbach, County Administrator, Risk Manager Erin Lundgren, Claims Coordinator CLAIMS CLAIMANT: Qwest CLAIM #: C-16-05 DAMAGES: $95.35 ALLEGATION: Damage to Underground Utilities DISCUSSION: The Risk Manager and Deputy Prosecuting Attorney reviewed the facts relating to this claim. It is recommended that the claim be denied on the basis that it is the obligation of the claimant to bury its underground equipment to a proper depth in order to prevent damage to its communication facilities. DECISION: Denied CLAIMANT: CLAIM #: DAMAGES: ALLEGATION: Jeffrey Kieffer C-17-05 $302.69 Vehicle Damage DISCUSSION: The Risk Manager and Deputy Prosecuting Attorney reviewed the facts relating to this claim and recommend that it be denied finding that road resurfacing operations were being performed by County staff in the Quilcene area on the incident date. However, County trucks traveling northbound (in the opposite direction of the claimant) would have been empty on the incident date, indicating that the object(s) in question would not have come from a County load, but, rather from a tire or the road, making this incident a "road hazard" for which the County is not liable. DECISION: Denied Risk Management Committee Minutes - September 14, 2005 Page: 2 CLAIMANT: Stephen J. Imholt CLAIM #: C-18-05 DAMAGES: $50,000+ ALLEGATION: False Arrest/Imprisonment and Assault DISCUSSION: The Risk Manager and Deputy Prosecuting Attorney reviewed the facts relating to this claim and find that since this matter went to trial, probable cause existed for the arrest. This claim is without merit and denial of it is recommended. DECISION: Denied Meeting adjourned.
