be denied, finding that Jefferson County was not in the vicinity performing work on the date
the damage occurred.

DISCUSSION: The Risk Manager and Deputy Prosecuting Attorney reviewed the above referenced claim. It
was agreed to recommend that this claim be denied, based on the finding that the Jefferson
County Road Crew was not performing road maintenance operations in June 2004 at the
location where the incident was said to have occurred. The only repaving work performed at
that location was asphalt patching which does not create tar.
DECISION: Deny claim
