HomeMy WebLinkAbout17 1128 94 ð.c: r',¡.J" <11-30p1~ P p.Y\M '..i '-' 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 STATE OF WASHINGTON County of Jefferson IN THE MATTER OF AN EMERGENCY ORDINANCE EXTENDING THE TIMELINE FOR ADOPTION OF INTERIM RESOURCE LANDS ORDINANCES } } } } } } ORDINANCE NO. 17-1128-94 WHEREAS, on October 28, 1994, the Jefferson County Board of County Commissioners adopted Ordinance No. 16-1028-94 (an ordinance repealing Interim Forest Lands Ordinance No, 07-0705- 94, Interim Mineral Lands Ordinance No. 06-0705-94 and Resolution No, 67-94 relating to Agricultural Lands); and WHEREAS, this ordinance deemed that an emergency existed due to the potential for noncompliance with the GMA creating uncertainty in the vesting of applications and difficulties in the issuance ofland use permits; and WHEREAS, the ordinance provided for the termination of all legal effect of existing GMA interim resource lands ordinances on November 30, 1994; and WHEREAS, the ordinance included a schedule (Exhibit A) that provided for receipt of public comment, analysis of economic data and submission of draft ordinances to the Board of County Commissioners by November 18, 1994; and WHEREAS, the County has worked in good faith to comply with said schedule, having reviewed all public comment received, conducted the required economic analysis, presented its findings to the Board of County Commissioners, and initiated production of new interim GMA resource land ordinances; and WHEREAS, the Board of County Commissioners directed county staff to further develop alternatives for the interim designation of forest resource land following completion of a workshop on November 21, 1994; and WHEREAS; the new interim GMA resource land ordinances require full legal review and the review of the Board of County Commissioners prior to their adoption; and WHEREAS; the November 30, 1994 termination date established by Ordinance No: 16-1028-94 severely restricts the ability of the county to adopt interim resource lands ordinances that will fully comply with the GMA; and WHEREAS, the conditions causing the emergency established by Ordinance No. 16-1028-94 are unchanged, NOW, THEREFORE BE IT ORDAINED, by the Jefferson County Board of Commissioners as follows: 1. The language established by Ordinance No. 16-1028-94 to amend Ordinance No. 06- 0705-94 and 07-0705-94 is hereby amended as follows: This ordinance shall terminate all legal effect on November 30, 1994 December 14, 1994 or upon such date as a new Interim Resource Lands Ordinance repealing this ordinance becomes effective, whichever occurs sooner. The language established by Ordinance No. 16-1028-94 to amend Resolution No. 67-94 is hereby amended as follows: This resolution shall terminate all legal effect on November 30, 1994 December 14, 1994 or upon such date as a new Interim Resource Lands Ordinance repealing this resolution becomes effective, whichever occurs sooner. This ordinance is necessary for the immediate preservation of the public peace, health and safety and shall become effective on the$ th day of November, 1994. If any portion of this ordinance is held invalid by any court of competent jurisdiction, such portion shall be deemed a separate portion of this ordinance and such holding shall not effect the validity of the remaining portion of this ordinance.
