ORDINANCE NO. 15-0814-95 The Jefferson County Board of Commissioners enter the following findings: 1. On August 1, 1994, the Jefferson County Board of Commissioners adopted the Jefferson County Zoning Code (No. 09-0801-94), repealing and replacing the Jefferson County Interim Zoning Ordinance (No. 1-01-6-92 and No. 2-0127-92). 2. On March 31, 1995, the County received a citizens' petition requesting changes be made to the Table of Permitted Uses, Section 6, Jefferson County Zoning Code (No. 09-0801-94). These changes being to permit offices, wholesale establishments, and veterinary clinics in the MC Light Industria/Commercial District. 3. On April 19, 1995, the Jefferson County Auditor certified that the petition was signed by ten (10) registered voters in Jefferson County, as required by § 24.21 Jefferson County Zoning Code (No. 09-0801-94) 4. Following staff review and concurrence by the SEPA Responsible Official, it was determined that the proposed amendments pose lesser and fewer impacts to the environment than were assessed in the Environmental Impact Statement for the Jefferson County Comprehensive Plan Implementing Ordinance, of February, 1994. 5. On May 16, 1995, staff mailed to the Washington State Department of Ecology a notice of "Adoption of Existing Environmental Document", thereby notifying DOE that on May 12, 1995, Jefferson County adopted by reference the Environmental Impact Statement for the Jefferson County Comprehensive Plan Implementing Ordinance, of February, 1994, for this proposed amendment. 6. According to the current zoning map the majority of the County's MC-zoned land is located in the Glen Cove Industrial Area, an area of approximately 600 acre being adjacent to the southern boundary of the City of Port Townsend. 7. The Joint Growth Management Steering Committee, comprising representatives of the City and the County, continues to work on establishing specific land uses and land use patterns for the Glen Cove Area which are consistent with the goals and objects of the Washington State Growth Management Act (RCW 36. 70A). At this time, the City and the County agree that the principal land use of the Glen Cove area will be light industrial/light manufacturing. 8. The Jefferson County Planning Commission held a duly advertised public hearing on July 12, 1995, to receive public comment on the proposed changes to the Table of Permitted Uses, Section 6, Jefferson County Zoning Code (No. 09-0801-94). The City did not submit comments on these proposed changes to the Jefferson County Zoning Code (No. 09-0801-94), prior to the Planning Commission's public hearing. Following the close of the formal public hearing the Planning Commission directed staff to contact the City of Port Townsend to request that the City submit written comments to the Planning Commission regarding the proposed changes. The Planning Commission moved to continue discussion of these proposed changes to their regularly scheduled July 19, 1995, meeting. The City of Port Townsend's comments were received on July 19, 1995, and were distributed to the Planning Commission at their meeting that evening. The City's conclusion read, in part: The City is concerned that amendments to the County Zoning Code to allow office uses within a light manufacturing area could partially frustrate the purpose of the existing MC district and increase the potential for land use conflicts within the Glen Cove area. We feel that general office uses are more appropriate within areas designated as commercial, and should not be allowed within manufacturing areas unless: Limited in size; and Directly related and subordinate to a manufacturing use. 12. The Planning Commission discussed the City's comments and concluded that the concerns expressed were addressed in the description of the district purpose of the MC Light Industrial/Commercial District (see §6,1 0 of the zoning code). 13. The Planning Commission approved, by a majority of the body, the ordinance and agreed to forward the ordinance, as written, to the Board of Commissioners with the recommendation to adopt. On August 7, 1995, the Board of County Commissioners reviewed the Planning Commission recommendations. The Board of Commissioners supported the City's concerns regarding the permitting of offices throughout the Glen Cove industrial area by continuing their discussion to August 14, thereby allowing staff to contact the City to further discuss the implications of the proposed changes. 15. On August 14, 1995, staff reported that the City continued to express their concerns regarding offices being permitted outright throughout the Glen Cove area. The primary basis for this concern was the belief that such activities, at this time, could partially frustrate the purposes of the existing MC zoning district. City staff did state that offices might be appropriate for the Glen Cove area at some point; however, further study of desired land uses in the area should be completed prior to the outright permitting of such activities. The Board concurred. The Board determined, that in their view, the proposed amendments to the Jefferson County Zoning Code would serve the interests of the citizens of Jefferson County, and would promote the public health, safety and welfare ~f the County as a whole. On Monday, August 14, 1995, the Board of County Commissioners unanimously agreed to amend the Table of Permitted Uses of the Jefferson County Zoning Code, Ordinance No. 09-0801-94, to permit outright, wholesale establishments and veterinary clinics, but not offices, in the MC Light Industrial/Commercial District. These changes become effective as of August 14, 1995. SECTION 3 Effective Date: This ordinance shall become effective on the 14th day of August, 1995. Box 1220 Port Townsend, WA 98368 (360) 385-9123 FAX: (360) 385-9357 1-800-831-2678 MEMORANDUM To: From: Date: Subject: Board of County Commissioners Long-Range Planning Staff August 8, 1995 Proposed Changes To Allowed Uses in the MC Light Industrial/Commercial Zone Thank you for giving me the opportunity to clarify the concerns that were expressed to you last Monday concerning the proposed change to the Jefferson County Zoning Code that would make offices an 'Allowed' use in the MC Light Industrial/Commercial Zone. Acting upon your suggestion, I contacted City of Port Townsend staff to gather some additional information related to the concerns they expressed in their letter dated July 17, 1995. The majority ofland currently zoned MC in unincorporated Jefferson County is located within the Glen Cove area. This area was recently identified by the Joint GMA Steering Committee as suitable for designation as a 'Community Serving UGA', eligible to receive publicly provided water and sewer services. This recommendation was made on the understanding that the Glen Cove area would serve as the focus for light industrial development in north eastern Jefferson County over the 20 year comprehensive planning period, providing a supply of land that is suitable for desired light industrial development by virtue of zoning, location, and availability of public facilities. The City of Port Townsend is concerned that by making offices an allowed use in this zone, the County will effectively reduce the amount of land available for light manufacturing in eastern Jefferson County - The idea being that offices will either be built on vacant land before industry needs it, or, that office uses will outbid industrial uses for whatever land is available. - This reduction in land available for light manufacturing will hurt economic development in Jefferson County and weaken the reason for a Glen Cove UGA. City staff did, however, state that the redesignation of some land in the Glen Cove UGA to allow offices would be a good idea. The concern is that offices should not be allowed to compete with light industrial land uses over the entire area. County Long-Range Planning staff support such an approach, and recommend that offices not be made allowed uses in the MC zone until an integrated approach can be worked out with the City and adopted with other permanent development regulations.
