Definitions: Accessory Dwelling Unit: A separate dwelling unit with separate cooking facilities that is substantially contained within the structure of a single family residence or an outbuilding which is accessory to such residence. Section 6.000 Table of Permitted Uses: Accessory Dwelling Unit: Exempt in all zones with the following provision. Exempt, when consistent with provisions of Subsection 6.20.11. Section 6020. Development Standards: 11. Accessory Dwelling Unit: Accessory Dwelling Units shall be subject to the following development standards: a. Maximum size: of 800 square feet. An Accessory Dwelling Unit shall have a maximum size b. Owner Occupied: To obtain an Accessory Dwelling Unit (ADU) designation, the owner of the subject property shall reside on the premises, either in the main-or accessory dwelling. The Owner Occupant shall reside in one of the units on the property for a minimum period of one year, provided, that in the event of illness, death or other unforeseeable event which prevents the owner's continued occupancy of the premises, the Development Review Division may, ~VOL. 21 r,\L~. 0 1~60 Ordinance No. 21,1218,95 Accessory Dwelling Units Page 2 upon a finding that discontinuance of the ADU would cause a hardship on the owner and/or tenants, grant a temporary suspension of this owner-occupancy requirement for a period of one-year. The Development Review Division may grant an extension of such suspension for one additional year, upon a finding of continued hardship. The Accessory Dwelling Unit (ADU) designation will run with both the land and the owner occupant. A property owner that has obtained a ADU designation can not apply for another ADU designation for a period of 1 year after the first ADU designation was granted. c. Certificate Of Occupancy: A certificate of occupancy pursuant to the Uniform Building Code shall be obtained from the building official and posted within the ADU. The code inspection and compliance required to obtain a Certificate of Occupancy in an existing building shall be restricted to the portion of the building, to be occupied by an ADU and shall apply only to new construction rather than existing components, except that any high hazards (i.e., smoke detectors, fire exits, stairways, LP gas appliances and fire separation) shall be corrected. One-hour fire separation is required for dwelling units in the same building. d. Outbuildings: Outbuildings may be constructed or expanded to accommodate an ADU within the structure. ADUs established in these outbuildings shall not be larger than 800 square feet in floor area. e. Exterior Entrance: In order to preserve the outward appearance of single-family neighborhoods, the front of the house shall have only one exterior entrance. A separate exit doorway to the outside is required for each dwelling unit. f. Not for Transient Accommodation: Neither the main nor accessory dwelling unit shall be used as a transient accommodation. Separate Stand Alone ADUs: Separate stand alone AD Us shall be a maximum size of 800 square feet, g. h. Number: Only one ADU may be established per single family residence. 1. Water Service: For the purpose of this ordinance, accessory dwelling units shall be served by the pre-existing water service to the primary unit. In no case shall new water service facilities be constructed to provide water to the accessory dwelling unit. Travel Trailer/ Recreational Vehicles: For the purpose of this ordinance, accessory dwelling units shall not be travel trailers, recreational vehicles, buses, truck storage containers or similar manufactured units which are not originally intended to be used for residences and built to the Uniform Building Code adopted by Jefferson County.
