ORDINANCE NO. 01-0102-96 Amending Ordinance No. 06-061592-92 Jefferson County Road Vacation Ordinance [The portions of the following sections shown stricken are to be removed from the Jefferson County Road Vacation Ordinance. NO OTHER SEC/10NS WILL BE MODIFIED] SECTION 2 DEFINmONS COUNfY: Jefferson County, State of Washington COUNfY ROAD: A public right of way, which lies outside the limits of any incorporated city, and that has been dedicated to, deeded to, established by usage, maintained, or otherwise established by the county. Such county roads shall be classified as follows: Class A: Roads established, dedicated to, deeded to, or otherwise established by the County for which no public expenditures have been made in the acquisition, improvement, or maintenance of same. EXCEPT those roads platted prior to l\4:arch 12, 1901 which remained unopened for public use for a period of five years after authority was granted for opening them. Class B: Roads established, dedicated to, deeded to, or otherwise established by the County for which public expenditures have been made in the acquisition, improvement, or maintenance of same EXCEF'f those roads platt-ed prior to March 12, 1901 'Nhich remained unopened for public use for a period of five years after authority was granted for opening them. Class C: Those roads platt-ed prior to March 12, 1901 which remained unopened for public use for a period of fiv-e years after authority was granted for ope-ning them. SECTION 4 ADMINISTRATION 4.10 APPLICATION: Petitions for road vacations shall be submitted, along with fees as provided by the Board of County Commissioners, in writing to the Department of Public Works. The petition shall be signed by a majority of owners of the frontage of the road or portion thereof proposed to be vacated. The petition must show the land owned by each petitioner and set forth that such county road is useless as a part of the county road system and that the public will be benefited by its vacation and abandonment. All fees and costs described herein shall be paid prior to the vacation becoming effective..... Subsection 1.80 of this Ordinance shall apply to the \'étcation of Class C roads; the remainder of Section 1 shall pertain to the va<:ation of Class A and Class Broads. 1.80 CL^.SS C ROAD 'lL^<C^.TIONS: In accordance with Section 32, Ch. 19, P. 603, Lav.tS of 1889 1890, roads which are classified Class C in this Ordinance are yacated by operation of law; hovi'eyer, action of record must be taken by Jefferson County to remove any cloud to title remaining as a result of a recorded interest in the County. At the time of application, the principal petitioner shall submit a request for a statutory or non use vacation, along with fees as pr(wided by the Board of County Commissioners. The petitioner must present proof that the road or right of way remained unopened f.or a period of fiv-e years follmving dedication in the plat. Such proof shall be in the form of SWDrn and notarized affidavits or public documents duly certified. VOL 22 i'AŒ 06 , . ~'O"". ... . The County Engineer shall prepare a report for the Board of County Commissioners stating 'Nhether the road '.vas yacated by operation of law and the County divested of its interest before the 1909 amendment, La\1{-S of 1909, Chapter 90, Section 1, 'which exempted from vacation by operation of law certain lands dedicat-ed for road purposes, became effective. The Board of County Commis8ioners shall make a final det-ermination whether the request shall be denied or approved.
