MINUTES
April 4, 2001
Deputy Prosecutor David Alvarez and Risk Manager David Goldsmith reviewed the following claims for damages.
Claims Coordinator Erin Lundgren was also present.
CLAIMS
CLAIMANT: Puget Sound Energy
CLAIM#: C-30-00
DAMAGES: $9,280.19
ALLEGATION: Damaged Power Pole
DISCUSSION: The Committee reviewed additional information requested from the Public Works Department
including sworn statements of two (2) Public Works employees attesting to the height of the
extended bed of truck at the time of the incident. Risk Manager David Goldsmith stated that
he contacted a representative of Sprint who feels it is highly unlikely that this one particular
guy wire was not at the appropriate height. The representative offered to give the County a
guy wire measuring pole for use by the Public Works Road Department when conducting
operations near power lines. Determining liability will be very difficult as there is a question
of fact. Deputy Prosecutor David Alvarez suggested that the Committee obtain the
manufacturer's specifications for the truck involved in the accident and that it be determined
if the road was repaved or resurfaced after the installation of the guy wire. The County and
Sprint may share liability for this claim. David Goldsmith will contact Sprint about
apportioning the amount of damages. It was agreed to table action on this claim pending
further investigation.

CLAIMANT: Thomas Murkowski
CLAIM#: C-6-01
DAMAGES: $479.96
ALLEGATION: Vehicle windshield damage
DISCUSSION: Risk Manager David Goldsmith reviewed the claim referenced above. Based on the
information provided by the claimant and the responding department, it was found that the
Jefferson County Road Crew performed chipseal-resurfacing operations on Center Road
which failed in the area where the incident occurred and resulted in the damages sustained.
DECISION: The Risk Manager and Deputy Prosecutor will recommend to the County Administrator that
the claim be paid.

CLAIMANT: Mike Belenski
CLAIM#: C-7-01
DAMAGES: $10,000
ALLEGATION: Violation of Civil Rights
DISCUSSION: Risk Manager David Goldsmith reviewed the details of the claim referenced above. Based on
the information provided by the claimant and the responding department, it was found that the
Jefferson County Sheriff's Deputy acted appropriately within the scope of his authority and
followed established police procedures. The Deputy had never met or seen the claimant prior
to this event.
DECISION: Denied
