CLAIMANT: Kenneth Baker
CLAIM#: C-28-01
DAMAGES: To be determined
ALLEGATION: Physical Injury
DISCUSSION: Risk Manager David Goldsmith and Deputy Prosecuting Attorney David Alvarez reviewed
the details of the claim for damages referenced above. Action was tabled on this claim
pending further investigation.
DECISION: Pending
CLAIMANT: Miles L. Soskin
CLAIM#: C-29-01
DAMAGES: $739.00
ALLEGATION: Delay of Building Project
DISCUSSION: Risk Manager David Goldsmith and Deputy Prosecuting Attorney David Alvarez reviewed
the details of the claim for damages referenced above. Based on the facts of the claim,
Deputy Prosecutor Alvarez suggested sending a letter to the claimant offering to settle for a
reduced amount. The Committee finds that there is the possibility that the claimant was
encouraged by County staff to seek a statutory vacation, thereby, justifying reimbursement for
the cost of the statutory vacation, or $64.00. Furthermore, the County is not obligated to
reimburse the claimant for the full cost of the survey, since it was not required that the
claimant obtain a survey for the statutory vacation and the information the claimant gained
from the survey continues to have value to the claimant. The County does not admit liability,
but, in the spirit or cooperation and in order to reach an amicable settlement, recommends full
and final settlement for the total amount of$200.00.
DECISION: The Risk Manager and Deputy Prosecutor will recommend to the County Administrator that a
reduced amount be paid for this claim.
Meeting adjourned.
