Home My WebLink AboutM03222000 RISK MANAGEMENT COMMITTEE MINUTES March 22, 2000 Prosecuting Attorney Juelie Dalzell and Risk Manager David Goldsmith met to discuss the following claims for damages. Claims Coordinator Erin Lundgren was also present. CLAIMS CLAIMANT: Hiddendale Community Club CLAIM NO: #C-6-00 DAMAGES: $4,027.59 ALLEGATION: County road crew broke waterline. DISCUSSION: The Risk Manager reviewed the additional information submitted by the Public Works Department in reference to this claim. It was agreed by both the Risk Manager and the Prosecutor that Jefferson County is not liable for the damages claimed, since,the installation of the water line was above the minimum 30 inches required for utilities within the right-of-way. Additionally,there is no franchise agreement between Hiddendale Community Club and Jefferson County. DECISION: The Risk Manager and Prosecutor will recommend to the Board of County Commissioners that the claim be denied. CLAIMANT: Kyung Lim Hong CLAIM NO: #C-4-00 DAMAGES: $9,804.00(property damage) ALLEGATION: Vehicle damage DISCUSSION: The details of the claim were reviewed by the Risk Manager and the Prosecutor. It was agreed that Jefferson County should pay the damages claimed. The Risk Manager stated that the payment amount for physical injuries is still pending. DECISION: The Risk Manager and Prosecutor will recommend to the Board of County Commissioners that the property damage portion of the claim be paid. Risk Management Committee Minutes of March 22 2000 Page: 2 CLAIMANT: Larry Scott CLAIM NO: #C-7-00 DAMAGES: $329.10 ALLEGATION: Vehicle damage DISCUSSION: Risk Manager David Goldsmith reviewed the claim referenced above. He stated that the claimant's vehicle was damaged after driving over freshly painted yellow road striping which sprayed the side of the vehicle and boat trailer. Risk Manager David Goldsmith stated that the damages sustained were the result of Action Services Corporation's performance as a contractor to Jefferson County. Under the terms and conditions of the contract,Action Services Corporation is solely responsible for any and all liabilities incurred while performing the work subject to the contract. DECISION: The Risk Manager and Prosecuting Attorney will recommend to the Board of County Commissioners that the claim be denied. Meeting adjourned.
