HomeMy WebLinkAboutM09222000 RISK MANAGEMENT COMMITTEE MINUTES September 22, 2000 Prosecuting Attorney Juelie Dalzell and Risk Manager David Goldsmith met to discuss the following claims for damages. Claims Coordinator Erin Lundgren was also present. CLAIMS CLAIMANT: Hiddendale Community Club CLAIM#: C-6-00 DAMAGES: $4,027.59 (Revised/Actual amount 9/28/00- $4,229.68) ALLEGATION: County road crew broke waterline. DISCUSSION: Risk Manager David Goldsmith explained that this claim was previously denied by the Board of Commissioners on April 3, 2000. The denial was based on the recommendation of the Risk Management Committee, finding that Jefferson County was not liable for the damages claimed, since the installation of the water line was above the minimum 30 inches required for utilities within the right-of-way. Upon further review of the claim, it was agreed that the County's right-of-way utility requirements were not violated since there was not a franchise agreement between the County and Hiddendale Community Club. DECISION: The Risk Manager and Prosecuting Attorney will recommend to the County Administrator that a half portion of the claim be paid ($2,119.84). CLAIMANT: Daniel D. Zerbe CLAIM#: C-21-00 DAMAGES: $5,000.00 ALLEGATION: Loss of freedom and employment resulting in mental stress, financial hardship & eviction. DISCUSSION: Risk Manager David Goldsmith reviewed the claim referenced above. It was agreed to table action on this claim pending further investigation. DECISION: Pending a Risk Management Committee Minutes - September 22, 2000 Page 2 CLAIMANT: Kelly Gordon CLAIM#: C-18-00 DAMAGES: $693.21 ALLEGATION: Damaged vehicle (see below) CLAIMANT: Dale S. Ackerman CLAIM#: C-19-00 DAMAGES: $129.84 ALLEGATION: Damaged vehicle (see below) CLAIMANT: Allen Rancourt CLAIM#: C-20-00 DAMAGES: $215.80 ALLEGATION: Damaged vehicle DISCUSSION: The claims referenced above were reviewed together as they all have similar allegations. According to the Public Works Department,the county road crew was working in the area where each incident occurred. DECISION: The Risk Manager and Prosecuting Attorney will recommend to the County Administrator that these claims be paid. CLAIMANT: Karin Belmont CLAIM#: C-22-00 DAMAGES: To be determined ALLEGATION: False arrest and imprisonment DISCUSSION: Risk Manager David Goldsmith reviewed the details of the claim referenced above. Based on information provided by the Jefferson County Sheriffs Office,there was probable cause for the arrest. DECISION: The Risk Manager and Prosecuting Attorney will recommend to the County Administrator that the claim be denied. Meeting adjourned.
