MINUTES
January 13, 1999
Prosecuting Attorney Juelie Dalzell and Risk Manager David Goldsmith were present. Leslie Locke was
present on behalf of Risk/Claims Coordinator Erin Lundgren. Public Works Director/County Engineer
Klara Fabry was also present to answer any questions relating to claims against the Public Works
Department.
CLAIMS
CLAIMANT: Genny Randall/Robert Randall(Son)
CLAIM NO: #C-30-98
DAMAGES: $3,704.71
ALLEGATION: Jefferson County Road Crew pulled down electrical service wire while spreading
gravel with dump truck. Raised box pulled electrical wire loose from mobile home,
breaking power pole in half and destroying meter,meter box and electrical panel
inside home.
DISCUSSION: Public Works Director/County Engineer Klara Fabry recommends the claim be paid
based on the fact that the Public Works Department surveyed five(5) other counties
in neighboring jurisdictions regarding the requirements used in their respective
county on power line heights. All counties had adopted other agency standards,if
they had any at all. Since the accident was not investigated after it happened, it is
believed that the power lines were at the minimum required height which is three
feet lower than the raised bed of a dump truck.
DECISION: Based on the information provided by the Public Works department,the Risk
Manager and Prosecuting Attorney agreed to recommend to the Board of County
Commissioners that the claim be paid.
CLAIMANT: Brinnon Community Church
CLAIM NO: #C-31-98
DAMAGES: $405.25
ALLEGATION: Jefferson County Road Crew broke water line while digging guard rail post. The
Road Crew also pulled down electrical service wire with raised box of dump truck
while spreading materials. Loss of water and power.
DISCUSSION: Public Works Director/County Engineer Klara Fabry recommends the claim be paid
based on the fact that the Public Works Department surveyed five(S)other counties
in neighboring jurisdictions regarding the requirements used in their respective
county on power line heights. All counties had adopted other agency standards,if
they had any at all. Since the accident was not investigated after it happened,it is
believed that the power lines were at the minimum required height which is three
feet lower than the raised bed of a dump truck. In addition,the damage to the water
line occurred when holes were being dug for guardrail posts for project#CR1306
Dosewallips Road.

DECISION: Based on the information provided by the Public Works department,the Risk
Manager and Prosecuting Attorney agreed to recommend to the Board of County
Commissioners that the claim be paid.
CLAIMANT: Nancy J. Leinius
CLAIM NO: #C-34-98
DAMAGES: to be determined
ALLEGATION: Vehicle damage and physical injuries sustained when rear-ended by a Jefferson
County vehicle driven by a Jefferson County Employee
DISCUSSION: The Risk Manager David Goldsmith explained that the claimant has some physical
injuries in addition to vehicle damage. This claim is pending further investigation.
DECISION: None
CLAIMANT: Whitney Howard
CLAIM NO: #C-38-98
DAMAGES: $689.62
ALLEGATION: Vehicle damage sustained when rear-ended by a Jefferson County vehicle driven by
a Jefferson County Employee
DISCUSSION: Risk Manager David Goldsmith stated the investigation shows the damage was the
result of a Jefferson County employee who was on duty and driving a County
vehicle at the time the incident occurred.
DECISION: Based on the indisputable facts,the Risk Manager and Prosecuting Attorney agreed
to recommend to the Board of County Commissioners that the claim be paid.
CLAIMANT: Reed Gunstone
CLAIM NO: #C-39-98
DAMAGES: $1,000,000+
ALLEGATION: Collapse of Old Gardiner Road due to blocked culvert, damaged property.
DISCUSSION: Risk Manager David Goldsmith explained that this land slide occurred 2 years ago.
The claimant installed a pipe on their property downstream from the County's
culvert under Old Gardiner Road restricting water flow and the claimant's clear-
cut logging contributed to the blocking of the culvert. The State Department of
Transportation is involved as well.
DECISION: Based on the facts,Jefferson County is not liable for the incident. The Risk
Manager and Prosecuting Attorney agreed to recommend to the Board of County
Commissioners that the claim be denied.

CLAIMANT: Mike Belenski
CLAIM NO: #C-40-98
DAMAGES: $100 per day...
ALLEGATION: Failure to attempt to provide requested information,violating the Washington State
Public Disclosure Act.
DISCUSSION: Risk Manager David Goldsmith reported that pursuant to RCW 42.17.340(4)the
assessment of monetary damages is to be determined by a Court of Law
DECISION: Based on RCW 42.17.340(4), the Risk Manager and Prosecuting Attorney agreed to
recommend to the Board of County Commissioners that the claim be denied.
