MINUTES
April 8, 1999
Prosecuting Attorney Juelie Dalzell and Risk Manager David Goldsmith discussed the following claims
for damages. Claims Coordinator Erin Lundgren was also present.
CLAIMS
CLAIMANT: Tom Paulson
CLAIM NO: #C-8-99
DAMAGES: $260.00
ALLEGATION: Failure to pay for yard maintenance after the Prosecuting Attorney's office
released property held as evidence for 5 % months.
DISCUSSION: Prosecuting Attorney Juelie Dalzell explained that the claimant's property was held
as evidence during the Nielsen/Berube Trial. She stated that while there was an
agreement between Mr. Paulson and the County to reimburse him for lost rents,
there was no agreement to pay anything beyond that. Statements from the Sheriff's
office personnel indicate that the yard was completely over grown at the time the
arrests were made and the residence secured as a crime scene. Additionally, only
the residence and a small area in the corner of the yard was secured. The
remainder of the property was available for maintenance. Risk Manager David
Goldsmith suggested reimbursing the claimant for a portion of the claim in the
amount $100.00 for what ever incremental vegetation growth had occurred while
the residence was secured as a crime scene, even though, from a strict liability point
of view no monies are owed.
DECISION: Based on the evidence,the Risk Manager and Prosecuting Attorney agreed that
Jefferson County is not obligated to reimburse the claimant for yard maintenance,
however,they feel it is fair to reimburse him for a portion of the expenses for what
ever incremental vegetation growth had occurred while the residence was secured
as a crime scene. This recommendation will be submitted to the Board of County
Commissioners for a final decision.
CLAIMANT: Laura Souza
CLAIM NO: #C-10-99
DAMAGES: $350.55 +
ALLEGATION: Physical injury to wrists, muscles in left leg, neck, & shoulders resulting from
tripping and falling over empty pallet in County building.
DISCUSSION: The Prosecuting Attorney and Risk Manager agreed to table discussion of this
claim pending further investigation.

CLAIMANT: Paul Tornensis
CLAIM NO: #C-11-99
DAMAGES: $486.85
ALLEGATION: Damage to grill and radiator of dump truck caused by driving into opened County
gate which was not visible.
DISCUSSION: The Prosecuting Attorney and Risk Manager agreed to table discussion of this
claim pending further investigation.
DECISION: None
CLAIMANT: Kim Bailey
CLAIM NO: #C-13-99
DAMAGES: $85,000.00+
ALLEGATION: Mud slide destroyed home and property due to the County's failure to inspect the
situation and take preventative actions.
DISCUSSION: The Prosecuting Attorney and Risk Manager agreed to table discussion of this
claim pending further investigation.
DECISION: None
CLAIMANT: David & Rita Keisling
CLAIM NO: #C-14-99
DAMAGES: To be determined
ALLEGATION: Damage to property causing evacuation of home due to County's failure to timely
clear culverts.
DISCUSSION: The Prosecuting Attorney and Risk Manager agreed to table discussion of this
claim pending further investigation.
