HomeMy WebLinkAboutM04281999 RISK MANAGEMENT COMMITTEE MINUTES April 28, 1999 Prosecuting Attorney Juelie Dalzell and Risk Manager David Goldsmith met to discuss the following claims for damages. Public Works Interim Director Frank Gifford and Public Works Road Supervisor Aubrey Palmer were present to answer any questions relating to claims against the Public Works Department. Claims Coordinator Erin Lundgren was also present. CLAIMS CLAIMANT: Laura Souza CLAIM NO: #C-10-99 DAMAGES: $350.55+ ALLEGATION: Physical injury to wrists, left leg, neck and shoulders resulting from tripping and falling over a pallet in a County building. DISCUSSION: The Risk Manager David Goldsmith outlined the details of the claim. According to the information provided,there was plenty of room to walk around the pallet and the room where it was located was well lit. In addition,the claimant has health insurance and sick leave through her employer which cover both on and off the job illnesses. The claimant is claiming loss of pay and medical expenses. DECISION: Based on this information,the Risk Manager suggested that the Committee recommend paying only the medical expenses not covered by the claimant's health insurance. Prosecuting Attorney Julie Dalzell agreed. The Risk Manager will write a letter to the claimant requesting that she submit documentation of her out-of- pocket medical expenses. Upon receipt, this recommendation will be submitted to the Board of County Commissioners for a final decision. CLAIMANT: Paul Tornensis CLAIM NO: #C-11-99 DAMAGES: $486.85 ALLEGATION: Damage to grill and radiator of dump truck caused by driving into opened County gate which was not visible. DISCUSSION: The Prosecuting Attorney and Risk Manager reviewed the details of the claim. The Risk Manager asked the Public Works representatives to comment. Road Supervisor Aubrey Palmer stated that Mr.Tornensis has continually used this turnout which is not established or maintained as a public way and use is not i authorized. Interim Director Frank a k Giff ord stated that theg ate which the driver struck is installed on State owned land and serves to prevent unrestricted access to the Penny Creek Quarry. The gate was reported to be open in a northerly direction and is 28 feet from the publically maintained right of way of Penny Creek Road. Had the driver of the truck been aware of the position of the gate in relationship to the direction of travel,the accident could have been avoided. RISK MANAGEMENT COMMITTEE MINUTES-APRIL 28, 1999 Page 2 DECISION: Based on the information provided,the Risk Manager and Prosecuting Attorney agreed to recommend to the Board of County Commissioners that this claim be denied. CLAIMANT: Tillie J. Stevens CLAIM NO: #C-15-99 DAMAGES: To be determined ALLEGATION: Damaged property due to mud slide. DISCUSSION: The Prosecuting Attorney and Risk Manager agreed to table discussion of this claim pending further investigation. DECISION: None CLAIMANT: Gerry Hodkins CLAIM NO: #C-17-99 DAMAGES: $426.44+tax ALLEGATION: Rock thrown from a County brush cutter broke left front(driver's side)door window of vehicle. DISCUSSION: The Prosecuting Attorney and Risk Manager reviewed the details of the claim. According to the Public Works department road crew personnel were working in the area at the time the incident occurred and verified the damages sustained. DECISION: The Prosecuting Attorney and Risk Manager agreed to recommend to the Board of County Commissioners that this claim be paid. The Risk Manager reported that claim #C-13-99 submitted by Kim Bailey and claim#C-14-99 submitted by David and Rita Keisling have been submitted to the Risk Pool and are still pending further investigation.
