HomeMy WebLinkAboutM07071999 RISK MANAGEMENT COMMITTEE MINUTES July 7, 1999 Prosecuting Attorney Juelie Dalzell and Risk Manager David Goldsmith met to discuss the following claim for damages. Public Works Interim Director Frank Gifford was present to answer any questions relating to the claim against the Public Works Department. Claims Coordinator Erin Lundgren was also present. CLAIMS CLAIMANT: Robb Bouma CLAIM NO: #C-18-99 DAMAGES: $452.92 ALLEGATION: Rock thrown from County truck damaged vehicle and windshield of vehicle. DISCUSSION: Risk Manager David Goldsmith reviewed the claim submitted. He stated that according to the information received from the Public Works Department the County is not liable for the damages sustained by the claimant's vehicle. Interim Public Works Director Frank Gifford stated that the County truck was empty at the time the incident occurred and the size of the rock previously being hauled was 7/8" minus, which is too small to cause the amount of damage that occurred to the claimant's vehicle. He added that it is standard procedure to sweep out the truck beds between hauls. The rock which hit the claimant's vehicle must have been projected from the road surface rather than coming from the bed of the truck, in which case, the damage is considered "road hazard". Prosecuting Attorney Juelie Dalzell and Risk Manager David Goldsmith agreed. Based on the photographs presented by the claimants, the damage was caused by a much larger rock than 7/8" minus and should be considered "road hazard". DECISION: The Risk Manager and Prosecuting Attorney will recommend to the Board of County Commissioners that the claim be denied. Risk Manager David Goldsmith reported that the claim of Melanie Balch #C-19-99 is pending further investigation. Meeting adjourned.
