Claims Coordinator Erin Lundgren and Assistant Claims Coordinator Leslie Locke were also present. CLAIMS CLAIMANT: Kris Hanson &Anna Jane Hanson CLAIM NO: #C-20-99 DAMAGES: Amount to be determined ALLEGATION: Property and Personal Damage DISCUSSION: Risk Manager David Goldsmith reviewed the claim submitted. He stated that according to the information received and analysis of facts performed by the WCRP attorney assigned to this claim,the County is not liable for the damages incurred. DECISION: The Risk Manager and Prosecuting Attorney concurred to have Attorney Mark Johnsen send a letter of denial to claimant. It will be recommended to the Board of County Commissioners that the claim be denied. CLAIMANT: Mike Belenski CLAIM NO: #C-21-99 DAMAGES: $1,000.00 ALLEGATION: Violation of 1st Amendment Rights DISCUSSION: Risk Manager David Goldsmith stated that the claimant was denied access to the District Court Courtroom. District Court has since changed its procedures to sustain an open court. It was agreed by the Risk Manager and Prosecuting Attorney that the claimant be awarded some compensation. The Risk Manager will contact the Risk Pool to determine the amount of damages to be paid. DECISION: The Risk Manager and Prosecuting Attorney will recommend to the Board of County Commissioners that the claim be paid. Risk Management Committee Minutes of August 11, 1999 Page: 2 CLAIMANT: Mike Belenski CLAIM NO: #C-22-99 DAMAGES: $500.00 ALLEGATION: Violation of 1st Amendment Rights DISCUSSION: Risk Manager David Goldsmith reported that the claimant was not deprived of any information lawfully due him. No compensatory damages were sustained. DECISION: The Risk Manager and Prosecuting Attorney will recommend to the Board of County Commissioners that the claim be denied. CLAIMANT: Mike Belenski CLAIM NO: #C-23-99 DAMAGES: $1,500.00 ALLEGATION: Harassment DISCUSSION: Risk Manager David Goldsmith reported that the claimant was not allowed to file an "Affidavit of Prejudice" in the District Court Office. Upon further research District Court corrected their error and filed the "Affidavit of Prejudice". The Claimant was not deprived of any information lawfully due him. No compensatory damages were sustained. DECISION: The Risk Manager and Prosecuting Attorney will recommend to the Board of County Commissioners that the claim be denied. CLAIMANT: Melanie Balch CLAIM NO: #C-19-99 DAMAGES: $63,714.16 ALLEGATION: Physical Injury DISCUSSION: Risk Manager David Goldsmith stated that the claimant has failed to cooperate with the claims adjuster hired by Jefferson County. Due to the lack of response it is determined that the claimant has forfeited and abandoned this claim for damages. DECISION: The Risk Manager and Prosecuting Attorney will recommend to the Board of County Commissioners that the claim be denied. Meeting adjourned.
