HomeMy WebLinkAboutM11291999 RISK MANAGEMENT COMMITTEE MINUTES November 29, 1999 Prosecuting Attorney Juelie Dalzell and Risk Manager David Goldsmith met to discuss the following claims for damages. Claims Coordinator Erin Lundgren was also present. CLAIMS CLAIMANT: Julie Ann Ryan CLAIM NO: #C-25-99 DAMAGES: $1,080.83 ALLEGATION: Vehicle Damage DISCUSSION: Risk Manager David Goldsmith reviewed the claim submitted. He explained that the damaged occurred when the claimant drove over freshly painted yellow road striping which sprayed the side of the vehicle. The damages sustained were the result of Action Services Corporation's performance as a contractor to Jefferson County. Under the terms and conditions of the contract,Action Services Corporation is solely responsible for any and all liabilities incurred while performing the work subject to the contract. DECISION: The Risk Manager and Prosecuting Attorney will recommended to the Board of County Commissioners that the claim be denied. CLAIMANT: Sprint CLAIM NO: #C-27-99 DAMAGES: $243.18 ALLEGATION: Damage to underground cable DISCUSSION: Risk Manager David Goldsmith stated that the County road crew personnel damaged underground cable lines while performing routine maintenance on Ole Torkelson Road. DECISION: The Risk Manager and Prosecuting Attorney will recommend to the Board of County Commissioners that the claim be paid. Risk Management Committee Minutes of November 29, 1999 Page: 2 CLAIMANT: Grant Rember CLAIM NO: #C-28-99 DAMAGES: $68,500.00 ALLEGATION: Property damage due to the County's failure to properly design, maintain and operate culverts. DISCUSSION: Risk Manager David Goldsmith reported that these allegations are similar to claims #C-13-99 and #C-14-99. Based on the information gathered by retained outside counsel in the investigation of those claims, it was concluded that Jefferson County was not negligent and that the damages resulted from extraordinary flooding due to record breaking rainfall. DECISION: The Risk Manager and Prosecuting Attorney will recommend to the Board of County Commissioners that the claim be denied. Meeting adjourned.
