Code of Washington amending Ordinance }
No, 04-0828-98 and Section 18,55 of the }
Jefferson County Code by establishing }
temporary uses of forty-five (45) days duration}
Ordinance No.o~ _1123 - 98
WHEREAS, the Jefferson County Board of Commissioners adopted the Land Use Applications
Procedures Ordinance No. 04-0828-98 on August 28, 1998; and,
WHEREAS, per WAC 197-11-800 (20) amendments to the Land Use Applications Procedures Ordinance
are exempt from review under the State Environmental Policy Act (SEP A); and,
WHEREAS, the Land Use Applications Procedures Ordinance requires a notice of application on all
permits except those specifically exempted under Section 5, Exemptions from Land Use Application
Processing; and,
WHEREAS, some temporary uses have a duration of forty- five (45) days or less; and,
WHEREAS, the Board has determined that temporary uses of forty-five (45) days or less duration should
not require a notice of application; and,
WHEREAS, Section 18,030 of the Jefferson County Code shall be amended to read",.. the temporary
activity or structure shall be permitted for a period of up to ninety (90) days" and to include the following
sentence: "Temporary Use permits approved for forty-five (45) days or less and processed without a
notice of application shall be permitted on a one time only basis each calendar year."; and,
WHEREAS, Section 6 (A) of the Land Use Applications Procedures Ordinance shall be amended to
identify as 6 (A) (4) Temporary Uses of greater than forty-five (45) days duration;
NOW, THEREFORE, BE IT ORDAINED, that temporary use permits limited to a maximum of forty-
five (45) days duration shall be considered exempt under Section 5 of the Land Use Procedures
Ordinance.

Washington establishing temporary uses }
of forty- five (45) days duration }
FINDINGS OF FACT
WHEREAS, the Board of Commissioners adopted Ordinance No. 08-1123-98 an interim ordinance
establishing temporary uses of forty-five (45) days duration on November 23, 1998; and
WHEREAS, the Planning Commission is currently reviewing permanent zoning regulations; and
WHEREAS, the intent of Ordinance No. 08-1123-98 will be reviewed and incorporated into final
development regulations; and
WHEREAS, a public hearing was held on May 17, 1999; and
WHEREAS, 36.70A.390 RCW allows an interim zoning ordinance to be renewed for one or more six-
month periods if a public hearing is held and findings of fact are made prior to each renewal.
NOW, THEREFORE, BE IT ORDAINED, Ordinance No. 08-1123-98 shall remain in effect until such
time as final development regulations are adopted or 6 (six) months from this date whichever occurs first.
