Community Development DATE: May 29, 2018 AGENDA DATE: June 4, 2018 SUBJECT: June 4, 2018, 6:00 PM Public Hearing regarding Planning Commission Recommendations on the Comprehensive Plan Periodic Review & UDC Update and DCD Staff Report STATEMENT OF ISSUE: Public Hearing: The Board of County Commissioners will hold a Public Hearing on Monday, June 4, 2018, at 6:00 PM in the Jefferson County Superior Courtroom, 1820 Jefferson Street, Port Townsend, Washington, for the purpose of taking written and oral testimony regarding the Jefferson County Planning Commission's proposed amendments to the Jefferson County Comprehensive Plan and amendments to the Unified Development Code (UDC), and staff recommended revisions and changes. Public Comment Period and Method to Provide Comment: Written testimony may also be provided before and after the public hearing via email at jeffboccL&co jefferson.wa.us or by U.S. mail to the Jefferson County Commissioners, P.O. Box 1220, Port Townsend, WA 98368, provided all written testimony is received no later than 4:30 p.m. Friday, June 8. Location of Documents: The public may view the Planning Commission's proposed amendments to the Comprehensive Plan and to the UDC, staff proposed additional recommendations, and supporting documents, by going to the "Latest News" section of the County's web page www.co.jefferson.us and clicking on the links, or by visiting the 2018 Comprehensive Plan web page at http://www.co jefferson.wa.us/578/Jefferson-County-Comprehensive-Plan. These documents may also be viewed at the Department of Community Development, 621 Sheridan Street, Port Townsend, Washington. Copies are also at the Jefferson County Public Library, Port Hadlock; and the Port Townsend Public Library. Regular Agenda ANALYSIS: The Board has requested a public hearing to receive additional public comments on the proposed action. Public testimony regarding the Planning Commission Recommendations and additional proposed staff changes outlined in the May 23, 2018, Staff Report to the BoCC (found in the Report's Attachment 3—Comprehensive Plan and Attachment 4—UDC) will assist the Board with decision-making. The Board will deliberate after the close of the comment period. Final action is anticipated before the end of summer. A draft adopting ordinance and Staff presentation notes are attached to this request. FISCAL IMPACT: There is no fiscal impact related to the hearing. RECOMMENDATION: Conduct public hearing as scheduled. JEFFERSON COUNTY STATE OF WASHINGTON AN ORDINANCE APPROVING MASTER LAND } USE APPLICATION 14-00086, ADOPTING } AMENDMENTS TO THE JEFFERSON COUNTY } COMPREHENSIVE PLAN AND APPROVING } MASTER LAND USE APPLICATION 14-00087, } ADOPTING AMENDMENTS TO THE UNIFIED } DEVELOPMENT CODE COMPLYING WITH } THE PERIODIC REVIEW AND UPDATE AS } REQUIRED UNDER WASHINGTON STATE } LAW AND THE COUNTY'S PERIODIC } ASSESSMENT. } WHEREAS, Jefferson County is required under codified as RCW 36.70A.010 et seq. and Jefferso, a periodic review and update of its Comprehensi, ensure consistency with updated state laws and i projections, and county policy decisions; and ORDINANCE NO. inagement' Act ("GMA") § 18.45 et seq: to conduct �elonment Regulations to population and employment WHEREAS, the Jefferson County Board of; Commissioners ("BOCC") has completed its professional periodic review, public notice, and public comment with respect to all proposed amendments to the County's Comprehensive Plan ("Comprehensive Plan"), originally adopted by Resolution No. 72-98 on August 28, 1998 and as subsequently amended; and WHEREAS, work on the 2018, Comprehensive Plan Update began in 2014 with the Jefferson County staff and the "Jefferson County Planning Commission ("Planning Commission"): Throughout this time, Jefferson County staff and the Planning Commission encouraged public participation, s in the planning process through public meetings, public hearings, and community -wide outreach programs. Discussions were held with the City of Port Townsend, tribal governments, neighboring counties, state, regional, special districts, other local partners, and the general public; and WHEREAS, Jefferson" County staff prepared a Comprehensive Plan and Unified Development Code` Amendment staff report which was made available to the public and presented to the Planning Commission and BoCC; and WHEREAS, the Planning Commission transmitted their recommendations on the periodic review and assessment of the Comprehensive Plan, Master Land Use Application ("MLA") 14-00086 and updates to the Unified Development Code, MLA 14-00087 on May 14, 2018; and WHEREAS, Jefferson County staff proposes amendments to the Comprehensive Plan and Unified Development Code to meet state regulations, to ensure document consistency, and MLA 14-00086 and MLA 14-00087 Docket Adoption Ordinance Page 1 of 3 to meet county -wide policies, in addition to amendments recommended by the Planning Commission; and WHEREAS, the Comprehensive Plan and Unified Development Code amendments were transmitted to the Washington State Department of Commerce, Office of Community Development and other agencies; and WHEREAS, the Comprehensive Plan and Unified Development Code amendments were included in a State Environmental Policy Act review; and WHEREAS, the BoCC finds that the amendments to the ComprehensivePlan and Unified Development Code will serve to benefit the health, welfare, safety, and lifestyle of the residents of Jefferson County; and WHEREAS, the BoCC finds that the amendments to the Comprehensive Plan and Unified Development Code satisfies GMA requirements and Jefferson County Code requirement for a periodic review and assessment. NOW THEREFORE, BE IT HEREBY O of Commissioners as follows: Section 1. Amendments to Comprehe Comprehensive Plan, MLA 14-00086 Washington State Department of Com amendments to hereby approved the Jefferson County Board 14-00086. The amendments to the ived and will be transferred to the velopment Code, MLA 14-00087. The Development Code, MLA 14-00087 are ashington State Department of Commerce. 3. Findings: The BoCC hereby adopts the recitals (the "WHEREAS" statement) as its findings of fact insupport ofxhis Ordinance Section 4. Severability. If any section, subsection, sentence, clause, phrase or section of this Ordinance or its application to any person or circumstance is held invalid, the remainder of this Ordinance or its application to other persons or circumstances shall be fully valid and shall not be affected. 5. Effective Date. The Ordinance becomes effective upon adoption by the BoCC.
