LEGAL COUNSEL:

Chair Erin Lundgren called the meeting to order at 10:35 a.m. in the presence of Members Philip
Morley, Vicki Kirkpatrick and Ruth Gordon and Legal Counsel Philip Hunsucker. Member
Lynn Sterbenz was absent. Sheriff David Stanko, Chief Criminal Deputy Sheriff Art Frank and
Prosecuting Attorney Michael Haas were also present for a portion of the meeting.
APPROVAL OF MINUTES
Member Gordon moved to approve the meeting minutes of August 1, 2017 as presented.
Member Kirkpatrick seconded the motion. The motion carried. The regular meeting for
September was cancelled.
OLD BUSINESS
BRIEFING re: Non-Minor Incidents that Resulted in Claims for Damages:
Sheriff Stanko
and Chief Criminal Deputy Frank briefed the Committee on prior incidents involving law
enforcement personnel. Sheriff Stanko stated that a procedural change has been implemented to
reduce certain types of claims. He also suggested that when a claim is filed involving law
enforcement, all records be provided to the Washington Counties Risk Pool (WCRP) to allow
for a complete review of the incident. Both Sheriff Stanko and Prosecuting Attorney Haas would
like to improve the lines of communication with the WCRP and outside legal counsel to provide
input in determining whether to approve, deny or settle a claim for damages.
EXECUTIVE SESSION
An Executive Session was scheduled from 11:30 a.m. to Noon with the County Administrator,
Chief Civil Deputy Prosecuting Attorney, Superior Court Clerk, Public Health Director, Clerk of
the Board/Risk Coordinator, Sheriff, Chief Criminal Deputy Sheriff, Prosecuting Attorney,
Central Services Director and Executive Assistant/Claims Coordinator regarding potential
litigation. This exemption is outlined in the Open Public Meetings Act RCW 42.30.110(1)(i).

The actual period of time the Committee met in Executive Session on this topic was from 11:20
a.m. to 11:40 a.m.
At the conclusion of the Executive Session the regular meeting was resumed. No action was
taken.

An Executive Session was scheduled from 11:00 a.m. to 11:30 a.m. with the County
Administrator, Chief Civil Deputy Prosecuting Attorney, Superior Court Clerk, Public Health
Director, Clerk of the Board/Risk Coordinator, Sheriff, Chief Criminal Deputy Sheriff,
Prosecuting Attorney, Central Services Director and Executive Assistant/Claims Coordinator
regarding Actual litigation. This exemption is outlined in the Open Public Meetings Act RCW
42.30.110(1)(i). The actual period of time the Committee met in Executive Session on this topic
was from 11:42 a.m. to 11:57 a.m.
At the conclusion of the Executive Session the regular meeting was resumed. No action was
taken.
EXECUTIVE SESSION
An Executive Session was scheduled from 11:58 a.m. to 12:05 p.m. with County Administrator,
Chief Civil Deputy Prosecuting Attorney, Superior Court Clerk, Public Health Director, Clerk of
the Board/Risk Coordinator, Central Services Director and Executive Assistant/Claims
Coordinator regarding potential litigation. This exemption is outlined in the Open Public
Meetings Act RCW 42.30.110(1)(i). The actual period of time the Committee met in Executive
Session on this topic was from 11:58 a.m. to 12:02 p.m.
At the conclusion of the Executive Session the regular meeting was resumed. No action was
taken.
NEW BUSINESS
No new business was discussed.
NOTICE OF ADJOURNMENT
Member Gordon moved to adjourn the meeting at 12:02 p.m. Member Kirkpatrick seconded the
motion. The motion carried.
