HomeMy WebLinkAbout070918_ca05Consent Agenda JEFFERSON COUNTY BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST TO: Board of County Commissioners Philip Morley, County Administrator FROM: Stuart Whitford, Environmental Public Health & Water Quality Director Roger Parker, Environmental Health Specialist DATE: July 9, 2018 SUBJECT: Bid Award — Solid Waste Abatement -890 Old Hadlock Road STATEMENT OF ISSUE: Jefferson County Environmental Public Health has solicited bids from automobile transport and wrecking companies in connection with solid waste abatement at 890 Old Hadlock Road, Port Hadlock, WA (the Subject Property), as authorized by the Reissued Writ of Abatement for 890 Old Hadlock Road (Warrant of Abatement), issued by the Jefferson County Clerk on March 6, 2018. On June 18th, 2018, Roger Parker (Environmental Health Specialist) opened and read two bids during the Board of County Commissioner's regular scheduled meeting. Environmental Public Health is requesting that the BOCC affirm our selection of Rollins Auto Wrecking as the successful bidder. ANALYSIS: See attached Bid Award Recommendation, copies of the two original bids, and copy of the bid package. Rollins Auto Wrecking is the lowest responsive bidder and as outlined in JCC 3.55.030 Competitive Sealed Bidding, shall be awarded the contract. In addition to being the lowest responsive bidder, other elements of Rollins Auto Wrecking's bid make it superior to the other responding bidder. The successful bidder understood that junk vehicles listed in the Warrant of Abatement might be removed from the Subject Property after the bid was submitted, and that the costs of the abatement could not be finalized until after any remaining junk vehicles listed in the Warrant of Abatement are removed by the successful bidder. JCC 8.10.950(8) provides: The costs and expenses of correcting a condition which constitutes a violation of these regulations shall constitute a personal obligation of the person to whom the abatement order is directed. Within 15 days of abating any violation, the health officer shall send the person named in the abatement order a bill that details the work performed, materials removed, labor used and the costs and expenses related to those tasks as well as any other costs and expenses incurred in abating the violation. In addition, pursuant to RCW 7.48.030, the expenses of abating the nuisance may be levied by the sheriff on the property of Mr. Anderson, and in this respect the warrant is to be deemed an Consent Agenda execution against property. Finally, RCW 7.48.270 provides that the expense of abating a nuisance, by virtue of a warrant, can be collected in the same manner as damages and costs are collected on execution. Environmental Public Health will bill Mr. Anderson for the net cost of the abatement pursuant to the JCC 8.10.950(8) and collect the abatement expenses pursuant to Chapter 7.48 RCW. FISCAL IMPACT: Estimated expenses for this solid waste abatement is to be $54,356.69, $22,897, net of scrap value, will be covered out of the HHS Site Abatement fund and Public Health's Abatement program funds will cover the remaining $31,460. Environmental Public Health will attempt to recover the net cost of the abatement pursuant to JCC 8.10.950(8) and Chapter 7.48 RCW. The Superior Court in and for Jefferson County ("Superior Court") has determined that a public nuisance exists at certain real property located in unincorporated Jefferson County at 890 Old Hadlock Road, Port Hadlock, WA, real property also known as Assessor's Parcel Number 901-112- 013 ("the Subject Property"). This Warrant of Abatement is titled 2017 Warrant of Abatement for 890 Old Hadlock Road because the process for obtaining it was begun in 2017 and there was an need to distinguish it from the abatements done on the Subject Property in 2012. 2. The Defendant, Michael Anderson, has created, condoned and worsened the nuisance by violating the terms of 2012 Amended Permanent Injunction. 4. The Superior Court has determined that items previously approved by the Jefferson County Public Health Department in 2012, which were not required to be removed by the Amended Permanent Injunction, is solid waste that is subject to removal from the Subject Property as part of the public nuisance worsened by the Defendant. 5. The Superior Court has determined that a 2017 Warrant of Abatement for 890 Old Hadlock Road should issue. 6. The Superior Court has determined that additional specific steps are needed to further abate and remedy the public nuisance at the Subject Property and said steps are authorized by this 2017 Warrant of Abatement for 890 Old Hadlock Road. 7. The Superior Court has issued an Order directing the undersigned to execute this 2017 Warrant of Abatement for 890 Old Hadlock Road on January 26, 2018. WARRANT OF ABATEMENT YOU ARE COMMANDED forthwith to abate the nuisance that exists at the Subject Property (Assessor's Parcel Number 901-112-103) in the following manner: 1. To read and announce the text of this 2017 Warrant of Abatement for 890 Old Hadlock I Road to the Defendant; 2. To leave and post this 2017 Warrant of Abatement for 890 Old Hadlock Road at a 1 prominent place or location at or upon the Subject Property, doing so in a weatherproof (generally plastic) container; 3. WARRANT TO SERVE IN LIEU OF TITLE FOR JUNK VEHICLES This 2017 Warrant of Abatement for 890 Old Hadlock Road shall serve in lieu of title(s) for any junk vehicle and the abatement of the public nuisance shall consist of removing, destroying,, and disposing of any vehicle or parts thereof and stored at the Subject Property. JUDGMENT ON ACCOUNTING OF ABATEMENT Upon application, the accounting of the expenses of gathering, transporting and disposing of I the solid waste required by this 2017 Warrant of Abatement for 980 Old Hadlock Road shall be reduced to a judgment against the Defendant.
