Allow for Conditional Refunding of }
Comprehensive Plan Amendment Fees}
ORDINANCE NO, 10-1108-99
WHEREAS, Jefferson County adopted a Comprehensive Plan on August 28, 1998; and
WHEREAS, the Comprehensive Plan states that proposed amendments to the Comprehensive Plan will
be considered on an annual basis; and
WHEREAS, the Board adopted Ordinance No. 02-0503-99 setting a fee for Comprehensive Plan
Amendment Petitions; and
WHEREAS, the Board desires that such refunds be determined by the Director of Community
Development according to the portions of the review process completed;
NOW, THEREFORE BE IT ORDAINED, that the Director of the Department of Community
Development is hereby granted authority to issue Comprehensive Plan Amendment refunds and that
Section 2 of Ordinance No. 12-1209-96 be amended to add the following subsection:
The Director of the Department of Community Development, or his or her designated representative, shall
provide refunds with respect to the fees paid by citizens for Comprehensive Plan Amendment proposals
as follows:
100 % Refund if and onlv if:
1. The petition was withdrawn with the result that the petition did not undergo review and analysis as an
amendment by the Department of Community Development or the Jefferson County Planning
Commission.
2. Petitioner's request was dealt with through a process other than that of a Comprehensive Plan
Amendment, for example as a mapping error or land use application, with the result that the petition
did not undergo review and analysis as an amendment.
50% Refund if and onlv if:
1. The proposal was rejected and was not forwarded on to the Planning Commission for review and a
public hearing, with the result that the petition did not proceed through the amendment process
beyond its initial presentation to the Board.
