Regular Meeting — Monday, June 25, 2018, 9:00 a.m.

CALL TO ORDER: Chair David Sullivan called the meeting to order at the appointed
time in the presence of Commissioner Kathleen Kler. Commissioner Kate Dean was absent.
PUBLIC COMMENT PERIOD: The following is a summary of comments made by
individuals in attendance at the meeting and reflect their personal opinions.
• Comment regarding code enforcement and neighbor issues.
• Comment regarding candidate forum last weekend, upcoming forums and national economics.
• Comment regarding code enforcement and neighbor issues.
• Comment regarding signage for an intersection at Uncas Road and Highway 101.
• Comment regarding a Consent Agenda item and information on future recycling in Jefferson
County.
• Comment regarding national immigration and a suggestion to implement punitive charges for gun

APPROVAL AND ADOPTION OF THE CONSENT AGENDA: Commissioner Kler
moved to approve all the items on the Consent Agenda as presented. Chair Sullivan seconded the
motion. The motion carried.

APPROVAL of MINUTES: Commissioner Kler moved to approve the Special Meeting
Minutes of June 4, and 14, 2018 as presented. Chair Sullivan seconded the motion. The motion carried.
Commissioner Kler moved to approve the Regular Meeting Minutes of June 11, 2018. Chair Sullivan
seconded the motion. The motion carried.
COMMISSIONERS BRIEFING SESSION: The Commissioners reviewed their
meeting schedules.
The meeting was recessed at 9:44 a.m. and reconvened at 9:59 a.m. with all three
Commissioners present.
HEARING re: Proposed Ordinance for Technology Fee Implementation:
Department of Community Development Building and Administrative Services Manager Jodi Adams
and Central Services Director Mark McCauley briefed the Board on a proposed ordinance that would
implement a technological fee.
Chair Sullivan opened the hearing for public testimony.
Tom Thiersch, Jefferson County: He stated he has questions and concerns about the proposed ordinance
and fee schedule and he is not opposed to the idea of charging fees to those who use services. The
benefit from the fees is not the issue. He is concerned about the lack of background information
regarding the size of this particular fee. In the Agenda Request there is no information whatsoever, no
analysis provided that shows what the budgetary need is going to be, how much money is expected to be
raised by this fee and whether or not it will actually accomplish its purpose which is to pay for the
support and for the software and building a reserve for future changes. That lack of analysis and
information disturbs him. How can you make an informed decision without information? It seems
somewhat lacking. The other part about it is 5%. How did you come up with that 5%? He looked up
other counties briefly and was not able to go through all 39 counties. He saw that none of them charged
a fee close to this high. Kitsap County charges 1 %. Pacific County charges a flat $10 fee for everything,

regardless if it's a $2,000 building permit or a $500 propane permit. It's a flat $10. He does not know
how the 5% came about, does not know how much money is expected to be raised, does not know how
much is needed. You are being asked to vote for something that is not particularly well documented. It
may have been well thought out, but there is no evidence of that thinking being presented to the public
for consideration. Thanks.
Mike Belenski: He stated he seconded what the previous speaker stated. He doesn't know if a lot of this
stuff pops up and you don't know the history of it, where it came from, who's deciding what. If it's an
ordinance, it seems you guys should be talking about it so people can hear how the numbers and where it
came from. Whether it came from this guy, or wherever it came from. Like Tom said, people need to
make informed decisions, not you know, here, sign this. Let's figure out the reasoning behind what's
being proposed. Thank you.
George Yount, Port Townsend: He stated that he supports the ordinance. It is well studied and its
conclusions certainly will make us more effective and more efficient. Thank you very much.
Hearing no further comments, Chair Sullivan closed the public hearing. After deliberation,
Commissioner Kler moved to adopt ORDINANCE NO. 05-0625-18 Amending Fee Schedules for the
Departments of Community Development and Public Works. Chair Sullivan seconded the motion. The
motion carried.
PRESENTATION re: Conservation Futures Citizen Oversight Committee
(CFCOC) Funding Recommendations for 2018: Conservation Futures Citizen Oversight Committee
(CFCOC) Chair David Wilkinson and Environmental Health Natural Resources Coordinator Tami
Pokorny briefed the Board on the 2018 CFCOC funding recommendations.
COMMISSIONER'S BRIEFING SESSION — Continued: The Commissioners
reviewed their upcoming meeting schedules.
The meeting was recessed at 10:45 a.m. and reconvened at 11:02 a.m. with all three
Commissioners present.
EXECUTIVE SESSION: An Executive Session was scheduled from 11:00 a.m. to
11:15 a.m. with the County Administrator and the Chief Civil Deputy Prosecuting Attorney regarding
Attorney -Client Privilege, Actual Litigation under exemption RCW 42.30.110(1)(i) as outlined in the
Open Public Meetings Act. The Board began the Executive Session at 11:05 a.m. and due to the need for
an immediate recess after the start of the session, recessed the session at 11:06 a.m. The Executive
Session resumed at 11:08 a.m. and concluded at 11:22 a.m. At the conclusion of the Executive Session
the Board resumed the regular meeting.
EXECUTIVE SESSION: An Executive Session was scheduled from 11:15 a.m. to
12:00 p.m. with the County Administrator and the Chief Civil Deputy Prosecuting Attorney regarding
Attorney -Client Privilege, Potential Litigation under exemption RCW 42.30.110(1)(i) as outlined in the
Open Public Meetings Act. The actual period of time the Board met in Executive Session on this topic
was from 11:23 a.m. to 12:31 p.m. At the conclusion of the Executive Session the Board resumed the
regular meeting.

ADDITIONAL BUSINESS: Letter to the Washington DepartineiA oTkrcl{aeology
and Historic Preservation (DAHP's): Commissioner Kler moved to authorize the Chair to work with
the Prosecuting Attorney's Office in preparing a response to the Washington DAHP's letter dated June
20, 2018. Chair Sullivan seconded the motion. The motion carried.
The meeting was recessed at 12:41 p.m. and reconvened at 1:33 p.m. with all three
Commissioners present.
EMPLOYEE RECOGNITION OF SERVICE: Jeff Ackerman, Roads Operator III,
Public Works: Public Works Director/County Engineer Monte Reinders presented retiring employee
Jeff Ackerman with a commemorative paperweight and commended his work ethic over the past 38
years of his employment with Jefferson County.
COUNTY ADMINISTRATOR BRIEFING SESSION: County Administrator Philip
Morley reviewed the following with the Board.
• Class Action Litigation re: Federal Payment in Lieu of Taxes (PILT): Commissioner Kler moved
to authorize Jefferson County to participate in a Class Action lawsuit regarding PILT and for the
Prosecuting Attorney's Office to represent the County in dealing with the contingent law firm.
Chair Sullivan seconded the motion. After further discussion, Chair Sullivan called for a vote on
the motion. The motion carried.
• ADDITIONAL BUSINESS re: MEMORANDUM of AGREEMENT (MOA) (2018-1) By and
Between Jefferson County and UFCW 21: Commissioner Kler moved to authorize the County
Administrator to sign the MOA on the Commissioner's behalf. Chair Sullivan seconded the
motion. The motion carried.
Miscellaneous Items
NOTICE OF ADJOURNMENT: Commissioner Kler moved to adjourn the meeting at
2:12 p.m. until the next regular meeting or special meeting as properly noticed. Chair Sullivan seconded
the motion. The motion carried.

NO QUORUM: Commissioner David Sullivan explained that there was no quorum of
the Board of County Commissioners to call the public meeting to order. He stated he will not address
any action items until Commissioner Kate Dean is able to join the meeting. He listened to comments
from the public in attendance. The following is a summary of comments made by individuals in
attendance at the meeting and reflect their personal opinions:

APPROVAL of MINUTES: Commissioner Dean moved to approve the Special
Meeting Minutes of June 19, 20 and 21, 2018 and Regular Meeting Minutes of June 18, 2018 as
presented. Chair Sullivan seconded the motion. The motion carried.
HEARING re: proposed Ordinance Modifying Chapter 3.42 of the Jefferson
County Code to Change the Title to "County Clerks Fees," and Add an Article Il, in Order to
Allow the Clerk to Charge for Access to the Electronic Court Records Management System
(ECRMS), Known as Odyssey: County Clerk Ruth Gordon explained her request to charge for access
to the Electronic Court Records Management System (ECRMS), also known as Odyssey. In 2015, the
Administrative Office of the Courts began to implement the Odyssey Portal which is a web based
application used to view court records and documents.
Chair Sullivan opened the hearing for public testimony.
Tom Thiersch, Jefferson County: I have concerns about the ordinance, particularly the way it has been
presented. The ordinance itself does not include any schedule of fees, it only states the maximum
amount. The only exclusions to those fees are for those people who are indigent and non -profits. Even
though the cover memo stated a representative fee schedule that may be used elsewhere. There is
nothing in the ordinance that actually states what the fee is going to be other than the upper limit. That is
a limit and should be corrected before the ordinance is approved. Second issue, as was just mentioned,
pro se litigants. Charging $100 is just a tax now on using the courts. If a pro se litigant wants to access
the system, it seems unfair, inordinately unfair. Pro se litigant may bring only one case per year, it seems
like $100 is a lot if you're just trying to represent yourself in traffic court or whatever. He requested that
the fee be reduced to something much less, like $25. You're talking about the cost of data entry maybe
once per year. Is that $600? I doubt it. Is it $100 for one person? I doubt it. $25, maybe. I've seen the
size of the application package, it is not that large. There may be a little bit of data entry, but not $100
worth of data entry. The other thing is, because there is no documents here available for this portal for
Jefferson County, you're not getting a lot for your money. I understand if you're trying to access
documents from other jurisdictions, than yeah, you might be getting a bargain. Why not have the clerks
of the court work out a system where they measure the amount of usage done per person and which

records from which counties they are accessing and allocate the costs accordingly? Not just do a flat fee
based on well, this person may want to come in here and do something. It seems like there is a
measurement, and organizational structure that is kind of missing to the whole approach that has been
done for this Odyssey. That would be a future improvement that would be more valuable and more fair
to all the users of the system. Lastly, with respect to Laserfische, until the County's documents are
available through the system, I would say that the maximum you should charge for the privilege of
logging in is $100. I don't see $600 worth of value. Thank you.
Mike Belenski, Jefferson County: I second what Mr. Thiersch said and that everything was right on
point. This is an ordinance, and the first I heard about it was two weeks ago. I don't know how it's all
getting massaged in the background, to be able to present it to you, but it would be nice to see where a
lot of this stuff in the ordinance came from, who's promoting it, who had comments against it. I don't
think there's been any of that. I haven't seen it. I just want to especially comment about pro se litigants
and for people who don't know what a pro se litigant is, it's someone who represents themselves. It is
Latin for "on one's own behalf." And so, my point is, Washington State Supreme Court, they treated me
just like a lawyer, I had all the benefits. I could file my stuff electronically. I'd ask for a case, they'd go
to the back and get it. I had to tell them a couple days ahead of time, and really thought they respected
access to the courts. Court of Appeals was a little bit different. I wasn't treated like a lawyer, I couldn't
file electronically. I couldn't get an account. So, I gotta drive my stuff down there. I don't risk mailing it
in because Mr. Alvarez made that mistake one time and we were standing there and the Judge is going
Mr. Alvarez where's your pleadings? You know, they ended up going to the wrong place and he's
dancing around like his feet are on fire. And so I don't wanna be that guy, so I'm driving it down there.
The point is, when you send it in to the State Supreme Court, within 5-10 minutes they email you back
and say we've got your stuff. So I know almost immediately if it got lost out in the internet somewhere
or did they actually get it. So I got proof of service that I gave it to them, and then you're carbon
copying the county or the other side. So yeah you're proof of service. My point is, I think that some
people respect, you know, just a pro se litigant's access to the courts and I think some places don't. So
what I would like to see is something in there for somebody to represent themselves that it doesn't cost
them a lot of money. So that's my comment. Thank you.
Joan Best: As an attorney, I can say that this is a valuable service, however, as it has been pointed out,
Jefferson County doesn't actually provide the major service and I have used the service in Kitsap
County for instance, where you can go online and put your number in and get all kinds of information
about ongoing court cases. Not just the one that you were interested, or I was interested in, but other
ones. So much more of value to the public in let's say the one they have in Kitsap County, using the
same system, Odyssey, but the information has to go online, which apparently Jefferson County has not
done yet. I strongly suggest that you consider putting it in your budget I guess, would be the thought.
Eventually, I would rather imagine that the state will require all counties to do it. So I do believe you
should pass this ordinance. It should be fairly inexpensive, $25. All you're getting is access to other
counties, you're not getting access to Jefferson County, but what it means is you don't have to leave
Jefferson County and drive down to Port Orchard to sign up. Until you've got more material put in,
that's what my suggestion would be, $25.

Clerk Gordon addressed public testimony and answered questions. She suggested minor edits to the

Commissioner Dean moved to adopt ORDINANCE NO. 06-0702-18 Modifying Chapter 3.42 of the
Jefferson County Code to Change its Title to "County Clerk Fees;" Make the Current Chapter into
Article I Titled "County Courthouse Facilitator Program Funding;" Add Article II Titled "Electronic
Access to Superior Court Records and Images" which allows registration and fee collection for access to
the Odyssey Case Management System; and, Add County Clerk Fees to the Jefferson County Code
Appendix. Chair Sullivan seconded the motion. The motion carried.
DISCUSSION re: Letter of Support for the Washington State Department of
Natural Resources (DNR) Washington Wildlife and Recreation Program (WWRP) Acquisition
Grant Application for Lands within the Dabob Bay Natural Area: Commissioner Dean moved to
approve sending a letter of support for the Washington Wildlife and Recreation program acquisition
grant application for lands within the Dabob Bay Natural Area. Chair Sullivan seconded the motion.
The motion carried.
ADJOURNMENT: Commissioner Dean moved to adjourn the meeting at 10:51 a.m.
Chair Sullivan seconded the motion. The motion carried. The remaining items on the Agenda will be
rescheduled at a later date.

BID OPENING re: Action via Sealed Bid of House and House Only located on APN
991200407, commonly known as 161 Rodgers Street, Quilcene, Washington: Treasurer Stacie Prada
explained that no bids were received. She added that even though there were no bids on the house, it is
still a good idea to try and save homes in the floodplains. She noted that the experience in dealing with
this situation can guide the County on how to handle other homes in floodplains in the future. Natural
Resources Program Coordinator Tami Pokorny will proceed in fulfilling the original terms of the grant
which will include the demolition of the home.
DISCUSSION re: RESOLUTION for Salish Behavioral Health Organization (BHO)
request to Create an Integration Pilot to the Washington State Legislature; Salish Behavioral
Health Organization (BHO): Regional Administrator Anders Edgerton, Public Health Department
Director Vicki Kirkpatrick and other local health organization representatives were present for the
discussion. County Administrator Philip Morley suggested a two week delay in the decision.
DISCUSSION and POTENTIAL ACTION re: Letter of Support: Commissioner
Dean moved to approve sending a Letter of Support for the Washington State Department of Natural
Resources (DNR) Washington Wildlife and Recreation Program (WWRP) Acquisition Grant
Application for Lands within the Dabob Bay Natural Area. Commissioner Kler seconded the motion.
After a brief discussion, Chair Sullivan called for a vote on the motion which carried by a unanimous
