HomeMy WebLinkAbout072318_ra01 JEFFERSON COUNTY BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST TO: Board of County Commissioners FROM: Philip Morley, County Administrator DATE: July 23, 2018 RE: Briefing on Fund 148 Affordable Housing Fund's Current Status & Future Revenue Projections STATEMENT OF ISSUE: At the July 23, 2018 meeting of the Board of County Commissioners staff will present a powerpoint presentation about the current status of Fund 148, the County's Affordable Housing Fund, and also describe revenue projections for future years, in view of state legislation adopted this year. ANALYSIS: State law (RCW 36.22.178, .179, and .1791) allows counties to charge surcharges on many of the documents recorded by the public at the County Auditor's Office, as a funding source for local and state affordable housing and homelessness programs. State authorization for most of those fees was scheduled to expire in the next year. Earlier this year the legislature enacted and the governor signed two bills (Engrossed Second Substitute House Bill 1570 and Engrossed Second Substitute House Bill 2578), which made authorization for the fees perpetual, and which also increased the fees. Since 2003, Jefferson County, the City of Port Townsend, and Olympic Community Action Programs (OIyCAP) have had a joint interlocal agreement designating OIyCAP as the administering agency for the administration and expenditure of the funds for affordable housing collected as authorized by RCW 36.22.178. Two years later, the County, City and OIyCAP signed a second joint interlocal agreement which also designates O1yCAP as the administering agency for the administration and expenditure of funds, this time for homelessness services, with fees collected as authorized by RCW 36.22.179 and .1791. On May 9 of this year, I wrote to the City Manager and Mayor as a follow-up to two meetings Commissioner Dean and I had with them in April, during which we had discussed updating the two interlocals to reflect the new state legislation, and suggested in the email holding meetings with all housing service agencies to have a broader discussion about how we might allocate those recording fee funds for affordable housing and homelessness services in the future. Per our discussion when the 4 of us last met,we will build into the Agreement some metrics for • reporting on financials and services provided,which will be shared with the County and City. • The road forward regarding future use of 2060 2163 funds- how does this sound: • Step 1: a meeting of City{Deborah and David),County(Kate and Philip);and OIyCAP(Dale Wilson and Kathy Morgan) - to do initial scoping of issues and options Step 2: a subsequent meeting to expand the circle to also include representation from Dove House,Habitat,Peninsula Housing Authority,COAST—to discuss the issues,options,and potential resolutions. This could end up being 2-3 meetings instead of just one. Step 3:After Step 2 is concluded,circle back to full City Council and Board of Commissioners—either as presentations to each,or as a joint meeting,as may be appropriate,depending on the results of Step 2. When the four of us last met, recall we discussed that the County should hold any other 2060&2163 funds that haven't yet been budgeted,so they might be resources to fund for the results of this broader discussion outlined above.Accordingly we're holding off for now,on OIyCAP issuing a RFP for other agencies to apply for those funds at this time. Jefferson County Administrator pmorlev(®co_ieffersonwa.us (360)385-9100 x-383 On July 2, 2018, the County received a letter from City Manager David Timmons with an attached Resolution adopted by the City Council directing him to "give notice of termination" of the two Interlocal Agreements, effective 90 days after giving notice, and tasking the City Manager and the City's Ad Hoc Committee on Housing to negotiate a new interlocal agreement for eventual consideration by the full City Council. On July 30, 2018, representatives from the County, OIyCAP and the City will hold a first meeting to begin discussions about developing a new ILA. The July 23 briefing to the County Commissioners is intended to help build a shared, factual understanding for the Commissioners, the City, OIyCAP and the public, about the funds being discussed: both the amount of existing funds in Fund 148, and projections of future revenues from the new recording fees.
