ORDINANCE NO. 01-0226-01
WHEREAS, RCW 26.12.240 authorizes the County to create a Courthouse
Facilitator Program to provide basic services to pro se litigants in family law cases; and,
WHEREAS, RCW 26.12.240 further authorizes the county legislative authority to
impose user fees or surcharge of up to ten dollars ($10.00) on only superior court cases
filed under Title 26 RCW to pay for the expenses of the courthouse facilitator program;
and,
WHEREAS, the Washington Legislature has previously found that domestic
violence is at the core of major social problems and has established a reduced statutory
filing fee for domestic violence cases filed under RCW 26.50 et seq; and,
WHEREAS, the Jefferson County Board of Commissioners have determined that
cases filed under RCW 26.50 et seq. should be excluded from the ten dollar ($10.00)
surcharge for the Courthouse Facilitator program.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners
of Jefferson County that the following shall apply:
Section One: Purpose
The purpose of this ordinance is to authorize the Clerk of the Superior Court of
Jefferson County to assess a ten dollar ($10.00) surcharge on certain superior court cases
filed under Title 26 RCW for the purpose of paying the expenses of the Court Facilitator
Program.
Section Two: Assessment of Surcharge
Pursuant to RCW 26.12.240, the Clerk of the Superior Court of Jefferson County is
hereby authorized to assess a surcharge of ten dollars ($10.00) on superior court cases
filed under Title 26 RCW except for those cases filed for domestic violence pursuant to
RCW 26.50 et seq.

Section Three: Collection of Surcharge
The Clerk of Superior Court of Jefferson County shall collect the surcharge in the same
manner that other fees and charges are collected.
Section Four: Payment of Surcharge to County Treasurer
Upon collection, the Clerk of the Superior Court of Jefferson County shall remit the
surcharge to the Jefferson County Treasurer on the first Monday of each month, who
shall maintain a separate account as provided in RCW 26.12.240.
Section Five: Savings Clause
If any court shall find any provision of this ordinance or its application to any person or
circumstance to be unconstitutional or otherwise invalid, such findings shall not affect
the validity of all remaining portions of this ordinance or the application of this
ordinance to other persons or circumstances.
