JEFFERSON COUNTY
BOARD OF COMMISSIONERS
AGENDA REQUEST
TO: Board of County Commissioners
Philip Morley, County Administrator
FROM: Trevor Hansen, Chief Civil Deputy, Sheriffs Office
Philip Hunsucker, Chief Civil Deputy, Prosecutor's Office
DATE: August 6, 2018
SUBJECT: PUBLIC HEARING re: Proposed Changes to Sheriffs Civil Fees;
Hearing Scheduled for Monday, August 6, 2018 at 10:30 a.m. in the
Commissioner's Chambers
STATEMENT OF ISSUE:
The Jefferson County Board of Commissioners will conduct a Public Hearing on Monday,
August 6, 2018 at 10:30 AM to accept public testimony regarding a proposed ordinance
Amending Chapter 3.70 of the Jefferson County Code "Sheriff's Fees."After accepting public
testimony, the Commissioners will deliberate on the hearing record and may take action to adopt
the proposed ordinance with or without changes.
The Sheriff's Office proposes several changes to existing County Code (Title 3, Chapter 070,
"Sheriff's Fees"): alter some of the fees the Sheriff's Civil Department charges for its services,
increasing most and decreasing or removing several; make certain services related to protection
orders "fee exempt" (free to use); add a fee for cancellation of enforcement on certain civil court
orders; create a procedure and fees for extended, non-emergency civil standbys by Sheriff's
Deputies; and update the current mechanism for automatic fee increases to be more user-friendly
and less frequent.
ANALYSIS:
Per RCW, the Sheriff charges fees for certain actions related to the service of process and the
enforcement of civil court orders. These fee types and amounts are set by RCW and can only be
changed or updated by the County Commissioners, not by the Sheriff. The Sheriff is not
generally permitted by law to waive fees for such services, as doing so would be favoring one
party or the other in a civil dispute.
In order to avoid putting victims of stalking, harassment, and domestic violence in increased
danger by excluding those who cannot pay fees, the Sheriff does currently waive fees for some
types of protection orders. The Sheriff requests that this practice be codified in County Code and
expanded to include all types of protective orders.
The changes to the existing fee schedule are intended to better reflect the costs of the Civil
Office. The Sheriff's Chief Civil Deputy has reviewed current fees, policies, and procedures and
compared these against state standards and against other Sheriff's Offices in the state. The
requested changes reflect the results of this review.
The new fees requested are primarily of two types: first, to reimburse the Sheriffs Office when
the enforcement of a civil court order is cancelled by the Plaintiff(usually a bank) after the
Sheriffs Office begins to work on the case; and second, to accommodate the recent increase in
requests for extended"Civil Standby" services.
A"Civil Standby" occurs when a law enforcement officer is called on by a citizen, or directed by
a court order, to provide security while the various parties in a dispute or domestic violence
situation exchange property for a brief period of time (typically 15-30 minutes). However, there
has been an increase in demand for Civil Standby services that last several hours or more (for
example, moving someone out of a home). JCSO does not have the manpower to accommodate
these lengthier requests without incurring overtime. The proposed change to the Ordinance
would establish a fee for this service. This fee would only be assessed for non-emergency
standbys lasting longer than 15-30 minutes. All civil standbys for protection orders would
remain free of charge. Eviction proceedings and other similar actions would be unaffected, as
the landlord already bears the cost of our presence during the entire eviction.
The notice of public hearing, for publication in the Port Townsend Leader, is attached as
Appendix A. The proposed ordinance, amending Ordinance No. 09-1123-15, is attached as
Appendix B. Appendix C is a copy of the relevant section of County Code as it currently exists,
with strike-through for removed language and underlined content representing the proposed new
language. The current fees, proposed fee update, and a listing of fees charged by three other
Sheriffs Offices, are all included in a chart attached as Appendix D.
FISCAL IMPACT:
There is no cost to the Sheriffs Office or the County. Any loss in fees due to the proposed
exemptions will be minimal, as the Sheriff already exempts most protective order services as a
matter of policy. Any increase in fees received would be used to support the Sheriffs civil
function.
RECOMMENDATION:
Conduct the Public Hearing, deliberate on the hearing record, and adopt the proposed ordinance
attached as Appendix B, with or without changes.
