MINUTES
Week of June 14, 1999
Chairman Dan Harpole called the meeting to order at the appointed time. Commissioners
Glen Huntingford and Commissioner Richard Wojt were both present.
PUBLIC SER VICES BRIEFING SESSION: Public Services Director Gary Rowe
reported on the following:
· He has drafted a memo to Director of Community Development A1 Scalf and the Prosecuting
Attorney Juelie Dalzell outlining the issues that were discussed at the Cape George "On the
Road" meeting last week.
· The Governor requested a FEMA disaster declaration for the damages from the storms earlier
this year. FEMA denied this request. The Board asked that a letter be drafted for them to sign
requesting that the Governor appeal this denial. There has been an impact to South County
businesses due to the damage to Highway 101 and the resulting closure.
· The Governor has approved the Salmon Recovery Funding package. A Recovery Funding Board
will be formed to handle requests from various agencies.
· Commissioner Huntingford asked that Treasurer Judi Morris be included in any discussions on
hiring a replacement for the Director of Health and Human Services.
Approval of Minutes: Commissioner Wojt moved to approve the minutes of the week of
June 7, 1999 as submitted. Commissioner Huntingford seconded the motion which carried by a
unanimous vote.

PUBLIC COMMENT PERIOD: The following items were discussed: There has been no
indication to Tri Area Community Council (TACC) about why the County has not held the public
hearing on the petition for the incorporation of Tri Area (Gary Rowe reported that he prepared a memo
for the Board regarding the petition for the incorporation of Tri Area. His understanding is that the law
requires a public hearing within 60 days of the date the petition was found sufficient by the Auditor
which would be around July 8); there is a need for a community recreation center in the Tri Area; the
public records request for proof of automobile insurance for Commissioner Huntingford; and the
schedule for the Tri Area/Glen Cove Study.
APPROVAL AND ADOPTION OF THE CONSENT A GENDA: Commissioner
Huntingford moved to delete the first contract on Item 5 and Items 6 and 13, and to approve and adopt
the balance of the Consent Agenda as submitted. Commissioner Wojt seconded the motion which
carried by a unanimous vote.

Commissioner Huntingford moved to approve and have the Chairman sign the letter to the Quinault
Indian Nation stating Jefferson County's support of their request to act as lead agency for WRIA 21.
Commissioner Wojt seconded the motion which carried by a unanimous vote.
COUNTY DEPARTMENT BRIEFINGS/BUSINESS
COMMUNITY DEVELOPMENT
Mike Ajax, Building Inspector re: Fee Waiver Request; Randy Brackett, Representing
Habitat for Humanity of East Jefferson County: Mike Ajax, Building Official, reported that the
Habitat for Humanity has just completed their first house in Port Townsend. They are now applying for
a building permit for a house in the County. Randy Brackett explained that the Habitat for Humanity is
interested in building houses outside the City. They are asking that the County waive the building
permit fees for these houses because they are for people who are at less than ½ of the median income of
the County which is currently $19,200 per year. The home owner also does a portion of the work on the
home.

Chairman Harpole asked if there is a time frame that the family must stay in the home? Randy Brackett
advised that if a home is put up for sale before the primary mortgage is paid off, there is a second
mortgage on the house for the cost of building it.
Chairman Harpole asked if the request is for an immediate project or for all such projects? Randy
Brackett explained that they are asking for both. Mike Ajax reported that he volunteered much of his
time on the first house. Chairman Harpole asked what the total amount of the fees would be? Mike
Ajax reported that the fees for the first house were about $962.00. A1 Scalf asked how many of these
houses would be done per year? Mike Ajax advised that the goal is 4 homes per year: 2 in the City, and
2 in the County.
Randy Brackett explained the criteria for the Habitat for Humanity uses for these projects. Chairman
Harpole suggested that the Board consider these requests on a individual basis until the program has
been in operation for awhile before any ordinance changes are made. Commissioner Huntingford stated
that he supports this project, but he has concerns about other citizens who are in the same situation, but
may not qualify for a Habitat for Humanity program.
Chairman Harpole suggested that A1 Scalf discuss this with the Budget Manager and bring a recommen-
dation back to the Board.
Discussion re: Public Notice Process for Subdivisions in Relation to Jefferson County
InternationalAirport: A1 Scalf reported that they have prepared information for the Board on how
notification is handled for subdivision near the airport. He read from the current EICO which requires
notification of all permits issued within the 65 LDN, which is smaller than the proposed area in the
Airport Noise Overlay ordinance.
Chairman Harpole stated that what the County is currently doing is similar to what the Port is asking be
done through the draft ordinance. He asked how many more possible building sites there are between
the 55 LDN and 65 LDN boundaries? A1 Scalfreported that he will have to check with Permit Center
staff to see how long it will take to provide this information. He will update the Board next Monday.
Larry Crockett, Port Manager, reported that the State law requires that the airport be identified as an
essential public facility in the County's Comprehensive Plan. He read from RCW 36.70.540 which
states that the County shall discourage siting of incompatible uses around the airport through the
Comprehensive Plan and development regulations. He noted that the Port is willing to work with the
County and the residents of the area on these issues.

Discussion re: Proposed WAC Guidelines to the Shoreline Management Act;
Washington State Department of Ecology: Associate Planner Lauren Mark reviewed the summary of
the new guidelines for the Shoreline Management Act. One major change is the requirement of a
shorelines inventory. An inventory has been done on 20 miles from Kala Point to Tala Point which cost
approximately $15,000 in grant monies. A biological report and engineering report was also provided
for this area. Jefferson County has 202 miles of saltwater shoreline, 367 miles of stream shoreline, and
14 miles of lake shoreline. It would cost approximately $1,000 per mile of shoreline for the County to
do the inventory that is required by these new guidelines. Chairman Harpole suggested that the
comment from the County include the information on the number of shoreline miles in the County and
the estimated cost per mile for this type of survey work. Commissioner Huntingford asked that a
comment also be added stating that this work should not be required of the County or individual property
owners.
A draft comment letter will be on the Board's agenda for approval next week.
Final Plat Approval; Large Lot Subdivision #LL02-92; To Divide Approximately 36
Acres into 8 Residential Lots; Located Near Camp Parsons at Pulali Point, Pulali Point Partners,
Applicant (See also Item 13 on the Consent Agenda) Jerry Smith, Associate Planner, reported on the
history of this project and the regulations in place at the time the application was made. Commissioner
Wojt moved to issue the final plat approval for the Large Lot Subdivision #LL02-92. Commissioner
Huntingford seconded the motion which carried by a unanimous vote.
Director's Update: A1 Scalf reported that he expects to have the Planning Manager and
Office Manager hired as soon as the required paperwork is complete.
PUBLIC WORKS
Update on Tri Area/Glen Cove Study: Bruce Laurie, Transportation Manager, reported
on the progress of the Tri Area/Glen Cove Special Study and how the time line fits with the petition for
the incorporation of Tri Area. He noted that the preferred alternative from the study regarding the Tri
Area UGA designation, and the Comprehensive Plan Amendment for the designation, will be completed
at a workshop on September 20, 1999.
Guy Rudolph stated that September 20 is 13 days past the date of the petitioners' election deadline. He
asked if the petition is dead? The Board indicated that is correct. Mr. Rudolph asked what the
community should do? Commissioner Huntingford noted that the Board is not happy that the study is
not on time, but the process has to continue even though it is behind the original schedule.

Commissioner Huntingford asked if Mr. Rudolph feels the information presented would indicate that the
incorporation is feasible if the Tri Area is designated a UGA? Guy Rudolph stated his concerns that
some of the cost estimates in the study are too high. Bruce Laurie reminded everyone that the informa-
tion in the study is in draft form and public comment will be taken before it is finalized.
Commissioner Wojt asked if the Prosecuting Attorney has been asked if a UGA could be declared on an
emergency basis? A1 Scalf reported that there is no legal basis for declaring a UGA.
HEALTH & HUMAN SERVICES
Director's Update: David Specter reported that he will provide an update for the Board
the next two weeks in order to assure an efficient transition when he leaves.
Loft School re: Report on Odyssey of the Mind World Competition: The students
repOrted that they were 8th in the overall division, out of 52 states and other countries making presenta-
tions. They enjoyed their visit to the University of Tennessee. Their performance was based on a
historical event that took place in 1917 with Mayor Israel Katz. The Historical Society and the Leader
provided assistance with the research.
Brinnon No Shooting Zone: A1 Scalfpresented a map with a draft boundary line for the
"No Shooting Zone." The Knootz's own a large portion of the property adjacent to the power line, and
are in favor of the "No Shooting Zone." Chairman Harpole noted that he was impressed by the
testimony of the Park Ranger from the Dosewallips State Park.
Commissioner Huntingford moved to approve the ORDINANCE NO 03-0614-99 to establish a "No
Shooting Zone" in Brinnon described as follows:
The area bordered on the east by Highway 101;
on the north by the Dosewallips Road;
on the west by the power line;
and on the south by the Dosewallips River.
Commissioner Wojt seconded the motion which carried by a unanimous vote.

The Board met in executive session from 2:30 to 3:15 p.m. with the Prosecuting
Attorney, the Director of Community Development and the Deputy Director of Public Services regarding
potential litigation.
The Board recessed their meeting on Monday at the conclusion of the scheduled business
and reconvened on Wednesday. Commissioner Wojt and Commissioner Huntingford were present.
Letter of Appeal re: Denial of Major Disaster Request: Commissioner Huntingford
moved to have the Chairman sign a letter to Governor Gary Locke asking him to formally appeal FEMA
Director James Lee Witt's denial of Washington State's request for a major storm declaration resulting
from the severe storms of last winter. Other Counties signing the letter include: Clallam, Grays Harbor,
Kitsap, Lewis, Mason, Pacific, Pend Oreille, Pierce, Snohomish and Thurston. Commissioner Wojt

Information ret~ardin~ the No-Shooting Area Petition
Many of the residents of the Brinnon area are concerned about the shooting that
occurs both in and out of hunting season. It is felt that we need some kind of
protection from the small percentage of people shooting firearms with no regard for
residences close by. We have a large herd of elk that stay in the general area of
downtown Brinnon and during hunting season this becomes a major fear. Last year
two elk were killed in the yard of one of our residents. The Sheriff's department has
advised us that there are no laws to govern this or any shooting. The County
Commissioners have enacted an ordinance, which permits us to request specific
identifiable no-shooting areas. This petition makes a formal request and will give
the Sheriff the authority to arrest anyone shooting a firearm in this area.

Re: Petition regarding Brinnon No Shooting Zone
Dear Mr. Johnston:
We have received and reviewed your petition requesting a change in the boundary of the Brinnon No
Shooting Zone as established by Ordinance No. 03-0614-99. During the time between the hearing and the
actual adoption of the ordinance, we researched and reviewed several options for the no shooting zone
boundary.
At the conclusion of this review which included the boundary as suggested in your petition, we felt the
power line would provide the most protection for the community. We are willing to consider requests for
special events within the boundary, such as the "Turkey Shoot" that was mentioned during the public
hearing. We want to leave the boundary as established for at least a year to allow residents of the area to
become familiar with it and to determine if it meet the needs of the entire community.

Please consider the following:
The area West of Schoolhouse Road appears to represent approximately 60%
or more of the total area included in the current boundaries of the No-
Shooting Zone.
There are only nine (9) permanent residents residing in the entire area
West of Schoolhouse Road vs. thirty (30) in the area bounded by Hwy.
101 and Schoolhouse Road, not to mention the Bayshore Motel and all
the businesses in the community.
By including the area South of Brinnon Lane, a buffer zone across the
Dosewallips River from the Park will still be in effect.
The wording "and all properties immediately adjacent to the West Side of
Schoolhouse Road" would then include the School grounds(a moot point
since it is already a Gun Free Zone) and the property on which the new
Fire Station-will be built, can be added to the "South on Schoolhouse
Road{ }to Brinnon Lane" proposed boundary description.
The residents of five (5) of the six (6) permanent homes in the proposed
area for exclusion are all over 50 years of age.
Ail residents in the proposed exclusion area are adult, law-abiding,
responsible, citizens living here permanently year-round.
The majority of personal property in the proposed exclusionary zone is
and shall remain posted as "Private Property" / "No Tresspassing" / "No
Hunting".
Your attention to the above facts when considering our Proposal
would be greatly appreciated.

Brinnon No Shooting Zone Established
We discussed the petition from Brinnon residents for a no shooting zone at our re~lar meeting
on June 14, 1999. Ordinance No. 03-0614-99 was approved to establish the Brinnon "No
Shooting Zone" with the boundary as described in the original petition.
This action was not taken lightly. We felt, after listening to your concerns about health and
safety at the public hearing on March 15, 1999; working with the Sheriffs Office to see if the
shooting problems could be resolved; and finally discussing the problems and concerns with you
again at our "On the Road" meeting; this was the best course of action to provide some
safeguards for the residents of Brinnon, Enclosed is a copy of the ordinance that establishes the
regulations for" No Shooting Zones" and a map with the Zone boundary,
As you will see there is no reference in this ordinance to allowing a shooting range or a special
event such as a "Turkey Shoot." We would be willing consider individual requests for these
activities on a case by case basis in the future, so that we can assure that notification for the
activity is provided, and that guidelines are established that will keep the integrity of the "No
Shooting Zone" in tact.
We have also enclosed information on the signs for posting the boundary of the zone. It is the
responsibility of the property owners within the boundary to provide and install the signs. You
may call Michelle at the Public Works Shop in Port Hadlock at 3854)890 for information on sign
shops in the area.

Since reading the review of the "On the Road" meeting in Brinnon May 17th, I don't think I am alone regarding this
subject either! (Ouch)
The agenda was advertised as an update to the slide/road closures south of us, NOT for a forum of the proposed NO-
SHOOTING zone in Brinnon. It seems the proponents of this took advantage of the moment and now we can feel the
sharp end of the pointed stick.
Since this was a rescheduled meeting from the 6th of May, I had a previous committment and could not attend.
I have been in contact with the state dept of fish & game and as a tentative licensed state ,qame farmer, they say I have
every right to use whatever means possible to protect any game birds I may be raising from preditors. If this right is
taken away from me by inclusion in the proposed NO-SHOOT ZONE, the state says ANY liability for loss or damage will
go to the county.
Have also been in communication with the district game enforcement officer, Phil Henry re: property and crop damage by
the local marauding ELK herd. I am told that I can use "Bird-Shot" to ward off any elk from damaging my property. Here
again, if this right is taken away from me by inclusion in a "NO-SHOOTING" zone, ANY/ALL liability will revert to the

The original problem that instigated all of this seems to have been taken care of. There has been relatively no shooting
activity from the irresponsible individual since being contactedlandlorltalked to by the county sheriff dept.
The ONLY reason property West of Schoolhouse Road was included was to make sure that individual was included in
the NO-SHOOTING Zone.
IF there is an established NO-SHOOTING Zone in Brinnon, I think all opposed to the present boundaries to the West of
Schoolhouse Rd would gladly support a zone between Hwy 101 and Schoolhouse Rd, and the Dose River Rd and the
Dose River.
