Dear Mr. and Ms. Fitzgerald:
Our office mailed you a Notice of Violation letter on December 15, 2004 outlining actions that
needed to be taken within thirty days to resolve your septic violation. Mr. Fitzgerald came in to
the office on December 29, 2004 to pick up the relevant applications. Since that date, we have
received no further information from you regarding your actions to resolve this violation. Your
property remains in violation status.
You must contact this office by August 15, 2006 to inform us of the actions you are taking to
resolve this violation. If we do not hear from you by this date, your case will be turned over to
the Prosecuting Attorney.
If you have further questions please contact this office at 385 -9444.

Dear Mr. And Mrs. Fitzgerald:
On April 8, 2003 staff from this office contacted you regarding the above
referenced property. The onsite sewage permit on record for the property is for a
pit privy for temporary use only with no water serving the site. It has come to the
attention of this department that the site has a water tap and that the site is being
occupied as a residence. It is now required that the onsite sewage system be
updated to comply with the current use. The site is currently in violation of the
permit on record.
Per Jefferson County code 8.15 Every place of residence shall be connected to an
approved onsite sewage system.
You are required to contact a licensed onsite septic system designer within ten
days and obtain a permit for the system within 30 days. If you choose not to
proceed the site would need to be vacated and the residence removed.
Per Jefferson County Code 8.15.080 A permit must be obtained prior to
commencing any work on an onsite sewage system.
