HomeMy WebLinkAboutM080718gON C'O �'I j G'00 N RISK MANAGEMENT COMMITTEE August 7, 2018 -10:30 a.m. MEETING MINUTES MEMBERS: Philip Morley, County Administrator/Risk Manager Erin Lundgren, Clerk of the Board/Risk Coordinator (Chair) Ruth Gordon, Superior Court Clerk Mark McCauley, Central Services Director Vicki Kirkpatrick, Public Health Director LEGAL COUNSEL: Philip Hunsucker, Chief Civil Deputy Prosecuting Attorney SECRETARY: Leslie Locke, Executive Assistant/Claims Coordinator Chair Erin Lundgren called the meeting to order at 10:35 a.m. in the presence of Members Vicki Kirkpatrick, Philip Morley and Mark McCauley and Legal Counsel Philip Hunsucker. Member Ruth Gordon arrived shortly after the meeting began. APPROVAL OF MINUTES Member Morley moved to approve the meeting minutes of July 3, 2018 as presented. Member Kirkpatrick seconded the motion. The motion carried. EXECUTIVE SESSION An Executive Session was scheduled from 10:30 a.m. to 11:00 a.m. with the County Administrator, Chief Civil Deputy Prosecuting Attorney, Superior Court Clerk, Public Health Director, Central Services Director, Clerk of the Board/Risk Coordinator and Executive Assistant/Claims Coordinator regarding potential litigation. This exemption is outlined in the Open Public Meetings Act RCW 42.30.110(1)(i). The actual period of time the Committee met in Executive Session on this topic was from 10:35 a.m. to 11:03 a.m. At the conclusion of the Executive Session the regular meeting was resumed. CLAIMS FOR DAMAGES DISCUSSION AND POSSIBLE DECISION Claim No.: #C-07-18 Claimant: Diane Weerts Damages: $65.35 Allegation: Damage to Windshield The Committee reviewed the details of this claim. The claimant alleges that the Public Works Road crew was performing road maintenance on Jacob Miller Road and while following a County dump truck her windshield was damaged by rocks causing a chip in the glass. Risk Management Committee Meeting Minutes — August 7, 2018 Page: 2 The Jefferson County Public Works Road Department submitted a recommendation that the claimant be reimbursed for the repair of the chipped windshield. Member Morley moved to approve payment of the claim in the amount of $65.35. Member Kirkpatrick seconded the motion which carried by a unanimous vote. The Executive Assistant/Claims Coordinator will prepare the necessary documents to process payment of this claim. Decision: Approved Claim No.: #C-08-18 Claimant: Grace Allen Damages: $1,355.00 Allegation: Vehicle Damage The Committee reviewed the details of this claim. The claimant alleges that the Public Works Road Crew was performing roadside paint striping on the corner of Oak Bay Road and Teal Lake Road. The claimant drove across the wet paint which caused paint to be sprayed on her vehicle. The Public Works Department submitted a recommendation to deny the claim due to the fact that the County was not performing the road striping work in question. This work was performed for the County by Apply -A -Line. On August 6, 2018, Claim #C-08-18 was forwarded to the Contractor for review. Member Morley moved to take no action on claim #C-08-18. Member Gordon seconded the motion which carried by a unanimous vote. The Executive Assistant/Claims Coordinator will draft a letter to be sent to the claimant. Decision: No Action Taken EXECUTIVE SESSION An Executive Session was scheduled from 11:05 a.m. to 11:35 a.m. with the County Administrator, Chief Civil Deputy Prosecuting Attorney, Superior Court Clerk, Public Health Director, Central Services Director, Clerk of the Board/Risk Coordinator and Executive Assistant/Claims Coordinator regarding actual litigation. This exemption is outlined in the Open Public Meetings Act RCW 42.3 0.11 0(l)(i). The actual period of time the Committee met in Executive Session on this topic was from 11:05 a.m. to 11:45 a.m. At the conclusion of the Executive Session the regular meeting was resumed. No action was taken. No old business was discussed. OLD BUSINESS NEW BUSINESS DISCUSSION re: Public Records Act Requests. The Committee discussed the potential risk of performing redactions in responding to public records requests.
