HomeMy WebLinkAbout100118_cabs011 of 2 JEFFERSON COUNTY BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST TO: Board of County Commissioners FROM: Philip Morley, County Administrator DATE: October 1, 2018 RE: Continued City/County Discussion re: Interlocal Agreement on Document Recording Fees for Homeless Housing and Affordable Housing STATEMENT OF ISSUE: On Monday, October 1, 2018 at 3:00 PM, County Commissioners will continue discussion with the City of Port Townsend’s Ad Hoc Committee on Affordable Housing about two draft documents attached to this memo.:  a draft Interlocal Agreement on Document Recording Fees for Homeless Housing and Affordable Housing, as well as  a draft Interim Homeless Shelter Service Agreement. The focus of this meeting will be to invite and hear community input on the two drafts, ANALYSIS: Two Interlocal Agreements (ILAs) were adopted in 2003 and 2005 regarding fees collected when documents are recorded with the County Auditor, and use of that fee revenue for affordable housing and homeless housing, as authorized by RCW 36.22.178, RCW 36.22.179 and RCW 36.22.1791. Both ILAs are now set to expire on November 25, 2018. (On September 17, the City Council voted to extend to November the City’s prior notice of termination.) Commissioners and County staff have met six times (July 30, August 9, August 29, September 4, September 10, and September 17, 2018) with the City’s Ad Hoc Committee and City staff to discuss and refine successive drafts of a new ILA between the City and County, plus an interim Shelter service agreement. The new ILA would conform with recent changes in state law regarding the recording fees and establish a new County/City structure for guiding how those funds are used. The interim Shelter service agreement would ensure the Homeless Shelter located in the basement of the American Legion can continue to operate as a year-round shelter through April 2020 without a break in service. The County Commissioners and the City’s Ad Hoc Committee have dedicated their October 1 joint session to hear review comments about the two draft agreements, from providers of homeless housing and affordable housing services, people who they serve, and other community members. The following documents are included with this memo  a draft Interlocal Agreement on Document Recording Fees for Homeless Housing and Affordable Housing,  a draft Interim Homeless Shelter Service Agreement, and 2 of 2  a draft detailed budget estimate that the Shelter operator, OlyCAP, used to develop total bottom line cost figures for the interim service agreement. The detailed estimate is attached as background information. The interim service agreement includes the bottom line budget figures, but not the line item detail contained in the estimate. Providers of homeless housing and affordable housing services, people who they serve, and other community members are welcome to attend the County/City Ad Hoc Committee joint meeting on Monday October 1, 2018 at 3:00 pm in the County Commissioners’ Chambers, to present comments to the Commissioners and Councilmembers about the two draft agreements. Written comments are also welcome. The Commissioners/Councilmembers will consider the public comment from this meeting in their continuing work to finalize the two agreements. All persons wishing to speak at the October 1 meeting will have three minutes each. The Commissioners and Councilmembers may ask follow up questions. After everyone has been heard, the Chair may allow for additional rounds of verbal comments, time permitting, or the Chair may invite further written comments instead. FISCAL IMPACT: None from the discussion. A new ILA, yet to be finalized, will potentially impact the collection and distribution of the recording fees. An ILA is required to collect and expend recording fees under RCW 36.22.178. RECOMMENDATION: Hear and consider public comments, ask questions, and continue joint County/City discussions to finalize a draft ILA, and to finalize a draft Interim Homeless Shelter Service Agreement.
