HomeMy WebLinkAbout08 0517 18 Health BoardSTATE OF WASHINGTON County of Jefferson In the matter of amending Jefferson } County Board of Health Ordinance } BOARD OF HEALTH Number 06-0517-12, Chapter 8.15 } ORDINANCE NO. 08-0517-18 JCC, On -Site Sewage Code } 1. Purpose. The purpose of this ordinance is to revise Jefferson County Board of Health Ordinance Number 06- 0517-12, which adopted Chapter 8.15 JCC, the On -Site Sewage Code, on May 17, 2012, through adoption by reference of the Washington State Department of Health Recommended Standards and Guidance for Performance, Application, Design, and Operation & Maintenance, Water Conserving On -Site Wastewater Treatment Systems, except Subsection A4 Pit Toilets, which can be located at https://www.doh.wa.v,ov/Portals/l/Docurnents/Pubs/337-016.pdf. 2. Authority. RC W 70.05.060 authorizes the Jefferson County Board of Health, among other things, to: (1) Enforce through the local health officer or the administrative officer appointed under RCW 70.05.040, if any, the public health statutes of the state and rules promulgated by the state board of health and the secretary of health; (2) Supervise the maintenance of all health and sanitary measures for the protection of the public health within its jurisdiction; (3) Enact such local rules and regulations as are necessary in order to preserve, promote and improve the public health and provide for the enforcement thereof; (4) Provide for the control and prevention of any dangerous, contagious or infectious disease within the jurisdiction of the local health department; and, (5) Provide for the prevention, control and abatement of nuisances detrimental to the public health. This ordinance is adopted base on the above authority. 3. JCC 8.15.030 Adoption by Reference. JCC 8.15.030 is hereby amended to read: The following are hereby adopted by reference as rules and regulations of the Jefferson County Board of Health: (1) Chapter 246-272A WAC, On -Site Sewage Systems Rules and Regulations of the State Board of Health, as it now or hereafter may amended; and, (2) The July 2012 Washington State Department of Health Recommended Standards and Guidance for Performance, Application, Design, and Operation & Maintenance, Water Conserving On -Site Wastewater Treatment Systems, as it now exists or hereafter may amended, except Subsection A4 Pit Toilets. 4. Severability. Provisions of this ordinance is hereby declared to be separable, and if any section, subsection, sentence, clause, phrase, or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. 5. Effective Date. This Ordinance shall be effective 10 days after approval is obtained from the department of health as per WAC 246-272A-0015(10). Approved and signed this day of 52018. The amendment to the On-site Sewage Code 8.15 is consistent with the intent of WAC 246-272A and is approved.
