MINUTES
'WEEK OF MAY 6,1996
The meeting was called to order by Chairman Richard Wojt in the presence of
Commissioner Glen Huntingford. Commissioner Robert Hinton was not present immediately.
He came in after the meeting had started.
~ROV AL OF TIlE MINUTES: Commissioner Huntingford moved to
approve the Minutes of April 22, 1996 as submitted. Chairman Wojt seconded the motion in the
temporary absence of Commissioner Hinton. The motion carried.
Bob Minty, Emer2ency Services Coordinator re: Special Event
Permit: Brinnon Shrimp Festival: Bob Minty reported that the required County Depart-
ments have reviewed this permit and everything has been done properly. He recommends
approval of the permit. Commissioner Huntingford moved to approve the Brinnon Shrimp
Festival Permit on the condition that all ofthe necessary signatures are obtained and the
insurance certificate is submitted. Chairman Wojt seconded the motion in the temporary
absence of Commissioner Hinton. The motion carried.
Appeal..m Service Officers Association Denial of Veterans Assistance
Application: The appellant, who had requested this meeting, was not present. Commissioner
Hinton noted that the information on applications submitted over several years for this appellant,
show inconsistent information regarding his service dates, his length of service, length of
residency in Washington, and the rank he attained in the service. He feels the Service Officers
Association made the correct determination in denying this application due to these inconsisten-
cies in the past and on this most recent application. The appellant must exhaust his administra-
tive remedies and it appears that he has failed to do that.
Commissioner Hinton stated that he doesn't feel the Board should be hearing an appeal of the
Service Officer's determination today. The Board would be asked to make a determination only
if it was the appellant's intent to deftaud the County by misrepresenting the material facts on the
application to obtain these public funds. He doesn't feel the Board has the jurisdiction to do this
type offact finding, and that the appellant's Fifth Amendment rights and his right to be repre-
sented by counsel may be compromised. Commissioner Hinton stated that he supports the
Veterans Assistance Fund. Revenues are limited, but with proper management and control of
abuse, assistance can be provided for all the Veterans and their families during difficult times.

Prior to the current Service Officers Association review, there were suspicions and allegations of
abuse of the Fund. The purpose of to day's discussion was to consider the denial of the latest
application by the appellant. This request cannot be considered in isolation of past issues of
deception and misrepresentation of material facts.
Commissioner Hinton moved to deny the appeal with prejudice and remand the matter back to
the Jefferson County Service Officers Association for further consideration and if the matter
cannot be resolved by them, it should be forwarded to the Jefferson County Sheriff's Office for
investigation. Commissioner Huntingford seconded the motion and stated that he also supports
the work of the Service Officers Association. This program is working better now than it ever
has.
The Chairman called for a vote on the motion. The motion carried by a unanimous vote.
PUBLIC SERVICES BRIEFING: Deputy Director of Public Services, David
Goldsmith, reported in the absence of the Public Services Director, on the following items that
are on today's Consent Agenda:
.. The policy for establishing criteria for County Departments to expend public funds for
eating and drinking. This policy has been reviewed by the Management Team.
The implementation procedures for the Public Works Salary System. The Organization
Chart and the annual Staffing Schedule will be the control for the number and type of
positions approved for the Public Works Department.
A grant application for an alternative space for Juvenile Detention. This would be a stop
gap program to provide Juvenile Detention bed space in a private home.
The following items are being worked on:
.. Clallam Jefferson Community Action Council has submitted a request for starting
discussion of reducing building rent for the spaces they use in the Multi-Services
Building.
A contract is being developed with Clallam County to purchase a bed for Juvenile
Detention in their facility.

APPROVAL AND ADOPTION OF THE CONSENT AGENDA: Commis-
sioner Hinton noted that he doesn't feel that the Board should consider adopting the Highway 20
Corridor Policy at this time. He feels it is premature to adopt this policy now because it should
be part of the Comprehensive Plan update process and adopted as part of the Zoning Ordinance.
The Clerk of the Board advised that the Public Works Department asked that Items 11 and 12 be
deleted ftom the Consent Agenda.
Commissioner Huntingford moved to delete items 1, 11 and 12, and to approve and adopt the
balance of the items as submitted. Commissioner Hinton seconded the motion which carried by
a unanimous vote.

A notification letter was sent to the applicant advising them that their Short Plat summary
approval would expire on April 15, 1995.
August 4, 1995 a fax was received ftom Jim Whittaker stating that he would let the.
subdivision lapse.
February 20, 1996 a letter was received ftom Jim Whittaker and Dianne Roberts request-
ing an administrative variance to reinstate the subdivision.

Permit Center staff recommends that this request be denied.
Commissioner Hinton asked how long the applicant has to complete the project once summary
approval has been granted? Michelle Wood answered that an applicant for a short plat has six
months ftom summary approval to complete the required work. They can request a six month
extension of time.
Jim Whittaker stated that they have done everything that was required for this Short Plat except
the road needed to access the building site. They didn't know that they only had to provide
access to the new lot, and not to the building site. They didn't want to finish a road until they
knew who would purchase the property and where they would locate a building site. Now if
they reapply, the density will not allow a five acre lot, it will have to be 10 acres. They
previously sold 25 acres in five acre pieces. Dianne Roberts noted that the properties in this area
are all five acres or less. '
Dianne Roberts stated that if they had known 1) that they would not have to cut down trees and
put in this road, and 2) that they would not be able to reapply at a later time under the same con-
ditions (density), they would have completed that short plat at the time. She explained that she
doesn't remember that there was ever any discussion of the fact that they didn't have to provide
an access to the new lot being created.
Commissioner Huntingford asked if there has been septic and water installed on the new lot?
Mr. Whittaker reported that there is a septic system approval for the new lot, but the system has
not be installed and the water will probably come ftom the well that serves their property.
Michelle Wood reported that when the applicants started this process the density in the area was
five units to one acre, then it went to one unit per one acre and now it's one unit per ten acres.
She also noted that the summary approval issued states the conditions for road improvements
and explains that they could apply for a variance ftom those conditions.
Chairman Wojt asked how many other short plats have been canceled in this area? Michelle
Wood answered that there was one other application in this area, as well as five to ten in other
areas.
Commissioner Hinton moved to concur with the recommendation of the Permit Center staff to
deny this request. Commissioner Huntingford stated that he understands fully what the
Whittaker's area going through, but must second the motion. If this was allowed to go forward it
would definitely create problems for the County by setting a precedent. The Chairman called for
a vote on the motion. The motion carried by a unanimous vote.
PUBLIC WORKS DIRECTOR BRIEFING: Public Works Director Klara
Fabry reported that on May 13, 1996 the construction work on Chimacum Road will resume.
The Road crew will also start on their summer schedule offour, ten hour days, on May 13, 1996.
The Public Works Rodeo is in Wenatchee this week. The Upper Hoh Road project is on
schedule. The National Park is working on the opening ceremony for that road later this month.
There is an RTPO meeting scheduled for Thursday.

Bayshore Motel: Warren Steurer reported that last year a lease proposal for management of the
Bayshore Motel in Brinnon was advertised in several newspapers. There was no response to that
advertisement, probably because the percentage required by the County was too high. A portion
of that percentage is to go to the Brinnon Senior Organization. He suggested that the manage-
ment of the motel be arranged with a person on a personal services contract. David Goldsmith
reported that he and the Prosecuting Attorney are working on an agreement that will make it
clear that person who manages the motel is not a County employee.

sioner Hinton stated that the Board determined that these fees be waived and reimbursement for
them be paid ftom the Road Fund to the Solid Waste Fund. Klara Fabry reported that only about
10% of the garbage came ftom County roads. Commissioner Hinton asked if there is some
funding available in the Solid Waste Fund? Klara Fabry reported that there was no budget es-
tablished for the reimbursement of this fee. The Public Works Department will check into how
this fee waiver has been handled in previous years and report back to the Board.

)!is.posaLFees: .kfferson County Cemetery ~: Commissioner Huntingford
reported that when he discussed this with AI Jakeway, he was told that most of the garbage
generated by the Cemetery District is grass clippings and tree branches. Cemetery District #2 is
a special purpose taxing district and the County doesn't waive solid waste fees for these Districts,
however grass clippings and other types of organic materials can be dumped at the compost
facility at the landfill at no charge.
Discussion re: Parks Advisory Board Proposal to Create a Fundin2
Source to Address the Elodea Weed Intrusion Problem at Lake Leland: Warren
Steurer reported that the Parks Advisory Board has reviewed this request £rom Chris Hertel and
made a recommendation that an addition $1 be charged or donated at Lake Leland to establish a
fund to finance the removal this weed ftom the Lake. There is a volunteer pay system at Lake
Leland and it is hard to get people to comply with it, and another $1 may not help that situation.
Commissioner Hinton asked how much would be generated in a year ITom an additional $1 ?
Warren Steurer answered that there are about 1,500 paying customers per year at Lake Leland.
Commissioner Hinton asked ifthere is a solution to control this weed? Commissioner
Huntingford reviewed the alternative methods to control the weed.
Chris Hertel, President of the Lake Leland Improvement Club, reported that they have met with
Jennifer Parson ftom the Noxious Weed Program with the State. There are grants available for
projects to control this weed in the Lake. The grant would only cover about 75% of the
necessary funding. He then explained that using carp in the lake would probably be the cheapest
and safest method of cleaning it up.
Commissioner Hinton asked if the Conservation District is addressing this issue? Chris Hertel
reported that he, and the Lake Leland Improvement Club, are working with an Intern ftom WSU
on the project. Commissioner Hinton agreed that since there is such a small impact ftom this
weed, now is the time to address the problem. Commissioner Huntingford asked what the total
cost of a clean up project is estimated to be? Chris Hertel said the total cost could be approxi-
mately $8,000 to $10,000. Commissioner Hinton suggested that the State Fish and Wildlife
Department be asked to be a partner in this project. The Board concurred that this project should
be pursued.
The meeting was recessed at the end of the scheduled business on Monday and
reconvened on Wednesday afternoon. All three Board members were present.
