MINUTES
Week of October 14, 1996
After the Chairman attended the Finance Committee meeting with the Treasurer
and Auditor, he called the Commissioners meeting to order. Commissioners Glen Hun-
tingford and Robert Hinton were both present.
PUBLIC SERVICES BRIEFING: Public Services Director Gary Rowe
reported on the following:
. He met with representatives of the Health and Human Services Department and State
Department of Information Services. The State has a grant to provide Internet access to
connect all the Public Health Departments statewide. Because this connection would be
made to the County's computer network, all of the County networked computers will
also have access to the Internet. The County must do the work to upgrade the computer
network system at the Health Department and the State will reimburse these costs. The
Board concurred that the computer network upgrade necessary is done. They asked
that an outline of exactly how these improvements will be funded be developed for their
reVIew.

The discussion of the BMP' s will be scheduled for next week. The Planning Commis-
sion will review the seawater intrusion portion of the BMP's this week.

Regarding the incorporation of Clallam Bay and Sekiu in Clallam County, Gary Rowe
reported that he called and discussed this with Clallam County Commissioner Phil
Kitchel and found out that both areas are designated as urban growth areas.

The CWSP Hearing was last week. Larry Fay will be outlining the process for review
of the comments and submit that to the Board at a later date.

Regarding the issuance of a permit for a rock pit on Penny Creek Road in Quilcene, the
County's decision can be appealed to the Hearing Examiner.

APPROVAL OF THE MINUTES: Commissioner Hinton moved to approve the
minutes of October 7, 1996 as presented. Commissioner Huntingford seconded the motion
which carried by a unanimous vote.
PUBLIC COMMENT PERIOD: The following issues were discussed: A request
was made that the Board look into the problems on a property located off Prospect Avenue; a
request was made that the County deal with the issue of allowable densities in rural areas; the
process that a property owner in Gardiner would have to go through to find out if he could
subdivide his property was reviewed by Al Scalf; why the PUD is involved in monitoring
alternative septic systems in the County, when the County has the authority to do this; and a
Cla11am County group set up to review requests for land use changes in the Forks area.
APPROVAL AND ADOPTION OF THE CONSENT AGENDA: Commissioner
Hinton moved to approve and adopt the consent agenda items as presented. Commissioner
Huntingford seconded the motion which carried by a unanimous vote.

CLOSED RECORD APPEAL HEARING re: Appeal of Hearing Examiner's
Decision Reversing the Administrative Decision; Quilcene Log Dump; Charles Manke,
Manke Lumber Company, Appellant (Closed Record Appeal No New Testimony): The
Chairman read the hearing procedures for the closed record appeal hearing and asked the
following questions:
Q) Is there anyone in the audience who objects to the participation of any of the County
Commissioners in these proceedings?
A) No one objected.
Q) Do any of the Commissioners have an interest in this property or issue?
A) All three Board members answered no.
Q) Do any of you stand to gain or lose any financial benefit as a result of the outcome of
this hearing?
A) All three Board members answered no.

opponents or proponents on the issue to be heard?
A) Chairman Wojt and Commissioner Hinton answered no. Commissioner
Huntingford stated that he had two calls at home last night asking if a hearing
would take place today.

Commissioner Hinton said that he didn't have sufficient time to review the record. He
apologized for any inconvenience and then moved that this hearing be continued until October
28, 1996 at 10:35 a.m. Commissioner Huntingford added that he would like to do more
research on a couple of questions and then seconded the motion.
Commissioner Hinton noted that no new testimony or information will be allowed in this case,
but the respective attorneys will have the opportunity to argue the case that was before the
Hearing Examiner. Mark Huth, Attorney representing the appellants, said that he understands
that a brief he submitted on Friday was not presented to the Board. The Clerk reported that
after checking with the Prosecuting Attorney, to make sure that the Board could see the brief,
it was given to the Board members.
The Chair called for a vote on the motion. Commissioner Hinton and Commissioner
Huntingford voted for the motion. Chairman Wojt voted against the motion. The motion
carried.
Commissioner Huntingford apologized to those present, but explained that he would like more
time to research a couple of issues he has concerns about.
Al Scalf again stated that this is a closed record appeal and the information presented by the
Chairman today will still be in effect. The attorneys will be allowed to state their arguments
for and against, based on the record of the Hearing Examiner which is certified and closed.
No additional information will be allowed into that record. The Board will then go into their
deliberation and come up with a written conclusion, based on the law.
Mark Huth stated that they are disappointed that this won't be heard today because many
people took their time to come to this meeting, but they prefer that the Board be completely
prepared to render a decision, and have reviewed the record. He asked that his clients not
contact any of the Board members in this interim period.
The meeting was recessed at the end of the scheduled preliminary budget
discussions each day and reconvened the following day for the scheduled budget reviews. All
three Board members were present each day, except Friday, when Commissioner Huntingford
was not present.

Temporary Closure of Traffic on Duckabush Road: County Road No. 227408:
Commissioner Hinton moved to approve RESOLUTION NO. 93-96 temporarily closing
Duckabush Road No. 227408. Chairman Wojt seconded the motion in the absence of
Commissioner Huntingford. The motion carried.
