Jefferson County Board of Commissioners
Regular Meeting — Monday, December 3, 2018, 9:00 a.m.
Jefferson County Courthouse—Commissioners' Chambers
1820 Jefferson Street, Port Townsend, WA
CALL TO ORDER: Chair David Sullivan called the meeting to order at the appointed
time in the presence of Commissioner Kate Dean. Chair Sullivan invited everyone in attendance to join
in the Pledge of Allegiance. Commissioner Kier participated via teleconference call.
PUBLIC COMMENT PERIOD: The following is a summary of comments made by
individuals in attendance at the meeting and reflect their personal opinions.
• Comment regarding activities on a neighboring parcel.
• Comment regarding activities on a neighboring parcel.
• Comment regarding staffing at the Department of Community Development and treating
Jefferson County like a business.
• Comment regarding activities of the member organizations of the Community Arts and
Recreation Alliance.
• Comment regarding possible land use violations regarding Concerts in the Barn in Quilcene.
• Comment regarding renaming a bridge in honor of Wally Bowman.
• Comment regarding a proposed shooting facility in Quilcene and funding for a Code
Enforcement Officer in the 2019 Budget.
• Comment regarding Conservation Futures program and fund recipient business Concerts in the
Barn, and a County employee who oversees the program.
• Comment regarding the Port Townsend shooting facility and the proposed shooting facility in
Quilcene.
• Comment regarding conservation easements with code violations,the proposed shooting facility
in Quilcene, and a filing of a 2nd Amendment lawsuit.
The Commissioners and County Administrator addressed comments and concerns raised during the
Public Comment Period.
APPROVAL AND ADOPTION OF THE CONSENT AGENDA: Commissioner
Dean moved to approve the items on the Consent Agenda as presented. Commissioner Kler seconded
the motion which carried by a unanimous vote.

of Jefferson County Commissioners are retained by the Jefferson County Auditor and Public Works Department.)
APPROVAL of MINUTES: Commissioner Dean moved to approve the Regular
Meeting Minutes of October 22, 2018 as presented. Commissioner Kler seconded the motion which
carried by a unanimous vote.
COMMISSIONERS BRIEFING SESSION: The Commissioners reviewed their
meeting schedules.
The meeting was recessed at 9:51 a.m. and reconvened at 10:02 a.m. with all three
Commissioners present.
HEARING re: Jefferson County 2019 Budget: County Administrator Philip Morley
and Central Services Director Mark McCauley gave a presentation on the 2019 Budget as proposed.
Chair Sullivan opened the hearing for public testimony. John Tevis, Department of Community
Development(DCD) Director Patty Charnas, Shirley Metz, Auditor's Office Accountant Judy Shepherd,
Tom Thiersch, Dan Toepper and Rebecca Taylor provided testimony.
Hearing no further testimony, Chair Sullivan closed the public hearing. The Commissioners deliberated
on the issue. Staff will work on technical corrections to the proposed budget and determine if Fund 148
needs to be separated into two funds, or if that could be done in the first quarter of 2019. The DCD
Director and the County Administrator will work on a prioritization and work program for DCD that fits
in with the departments' existing tasks.
CONTINUED DELIBERATIONS re: Periodic Update of the Comprehensive Plan
and Unified Development Code Amendments: Department of Community Development(DCD)
Planning Manager Austin Watkins and Associate Planner Joel Peterson briefed the Board on a

other counties' Conditional Use criteria, and reviewed the Comprehensive Plan and Unified
Development Code Amendments. Staff will make edits for final review and possible adoption by the
Board on December 10, 2018.
Commissioner Kler excused herself from the teleconference call at 12:38 p.m.
The meeting was recessed at 1:07 p.m. and reconvened at 1:33 p.m. with Chair Sullivan
and Commissioner Dean present. Commissioner Kler joined the meeting via teleconference call at
1:34 p.m.
PRESENTATION and DISCUSSION re: Ordinance HarmonizingTitle 18 of the
e
Jefferson County Code with Commercial Shooting Facilities Ordinance No. 12-1102-18 and
Planning Commission Recommendation: Chief Civil Deputy Prosecuting Attorney(DPA) Philip
Hunsucker and Department of Community Development(DCD) Planning Manager Austin Watkins
gave a presentation and answered questions on the proposed harmonizing ordinance. A hearing
regarding the proposed ordinance is scheduled for Monday, December 10th, 2018 at 6:00 p.m. in the
Commons at Fort Worden.
PROJECT PRESENTATION re: Conservation Futures Fund Agreement to
Implement the Chimacum Forest(Short's Forest) Conservation Futures Project: Natural Program
Coordinator Tami Pokorny briefed the Board on the Chimacum Forest project. After review,
Commissioner Dean moved to approve the agreement to implement the Chimacum Forest(Short's
Forest) Conservation Futures Project. Chair Sullivan seconded the motion which carried by a unanimous
vote.
The meeting was recessed at 3:07 p.m. and reconvened at 3:15 p.m. with Chair Sullivan
and Commissioner Dean present. Commissioner Kler joined the meeting via teleconference call at
3:16 p.m.
EXECUTIVE SESSION: An Executive Session was scheduled from 3:00 p.m. to
3:20 p.m. Chair Sullivan announced that the Executive Session will be held from 3:16 p.m. to 3:40 p.m.
with the County Administrator, Chief Civil Deputy Prosecuting Attorney and Community Development
Director regarding Attorney-Client Privilege, Potential Litigation under exemption RCW 42.30.110(1)(i)
as outlined in the Open Public Meetings Act. The Board resumed the regular meeting at 3:40 p.m. Chair
Sullivan announced that the Board will be extending the Executive Session from 3:40 p.m. to 3:50 p.m.
The Board concluded the Executive Session and resumed the regular meeting at 3:51 p.m.

COUNTY ADMINISTRATOR BRIEFING SESSION: County Administrator Philip
Morley reviewed the following with the Board.
• Miscellaneous Items
o Washington Counties Risk Pool (WCRP); insurance rate increases are anticipated
o Climate Action Committee; software program request to track inventory of greenhouse
gases
o 2019 Committee Assignments
• Calendar Coordination
• Quilcene Clinic opening
• Information received re: spent uranium emissions
• Petition re: Sportsmens Association
ADDITIONAL BUSINESS: AGREEMENT re: Fort Worden Commons for a Board
of County Commissioners Special Meeting to be held December 17,2018 at 1:30 p.m. re:
Deliberations on the Proposed Ordinance Harmonizing Title 18 of the Jefferson County Code with
Commercial Shooting Facilities Ordinance No. 12-1102-18: Commissioner Dean moved to authorize
the Chair to sign an agreement with Fort Worden for the use of their Commons meeting space to hold
the Special meeting of the Board of County Commissioners on December 17, 2018. Commissioner Kler
seconded the motion which carried by a unanimous vote.
NOTICE OF ADJOURNMENT: Commissioner Dean moved to adjourn the meeting at
4:19 p.m.until the next regular meeting or special meeting as properly noticed. Commissioner Kler
seconded the motion which carried by a unanimous vote.

I will not be able to make it to the public comment period on the 2019 budget, so I wanted to
make a comment from my perspective. First off, thank you for recording the public meetings on AV
Capture. It makes the opportunity available for people who work during the day to see what is
happening. With all the work that has gone into the budget, I am imagining that it will pass with some
minor changes, but I would like to look into the future. I don't have a dream of our county getting on
board with the economic upturn we have going on in our nation and even our state. I don't have a
dream that small businesses, which hire one or two people at minimum wage, will pull us out of the hole
our economy is in. I don't have a dream that our economic development group (Team Jefferson) will
come up with an idea to help make a dent in the development of our economy. I don't have a dream
that we will pull out of the economic recession before the next one hits.
During a PIF Board meeting the mayor of Port Townsend made a statement: "Sales tax! What
do we get - $80,000 on a million dollars of sales? Commercial builds are what grows our revenue."
Although Kate Dean and Philip Morley sat near her, the wisdom in that statement slipped right by them.
As I drive around Port Townsend I see that statement starting to take place. What about the county?
The leadership continues to hang on to the small business model. How has that worked over the last
fifteen years. I was comparing Jefferson County's proposed budget to that of Kitsap County's budget. In
a chart I saw that in 2010, 2011, 2012, 2013, 2014, and 2016 their revenues were higher than their
expenditures. That is in the middle of the recession. Yes, they made serious cuts, but they have a
dream and it is paying off. Do you know Silverdale is an Urban Growth Area (not an incorporated city) —
like Port Hadlock — all of those property taxes go directly to the county.
So, will citizens only hear of how bad the one percent lid on property taxes affects our efforts, or
how we just need to give things more time (another 15 years), or how the defeat of Prop 1 in 2017
somehow continued the poor recovery we have faced. Will you state all the options? Don't you think
the citizens realize the one percent lid keeps you from digging deeper into our pockets. The one percent
lid was intended to promote development as opposed to increasing taxes. Will you state that new
builds, commercial and personal, are outside of the one percent lid in more than just a side note. Will
you inform citizens that the property taxes on commercial builds significantly increase county revenue. I
don't have a dream that these will even be discussed and we are doomed to more years of mediocrity.
Thank you for your time, and I hope someday you will hear the cries of the people in the county,

Dear County Commissioners,
I am unable to attend today's public hearing on the 2019 budget, so I'm submitting this in writing.
As resident of Jefferson County, I strongly support your efforts to support a code enforcement officer position in the
new budget.
I am writing to you as a private citizen. A significant part of my job includes public education and awareness around
good stewardship of shoreline and marine habitats. Education goes a long ways, but it is frustrating to citizens who do
the right thing to see their neighbors doing illegal activities with no consequences. My concern extends beyond
"unfairness" to the cumulative consequences that affect not only the violator's property but beyond those boundaries
to public lands, streams and other properties.
I urge you to keep this item in the budget and figure out a way to support code enforcement.

I'm Peter Newland. I live on Tarboo Bay
Sing the
Tarboo Ridge Coalition. We request these comeference in
the record of your budget hearing to be held later today.
On Monday November 10, 2018 the TRC provided you evidence that Fort
Discovery Corporation is, during the moratorium on gun ranges, and without
permits, excavating and grading hundreds of yards of material, rerouting
drainage courses, and, possibly, filling wetlands. The disturbance encompasses
almost 2 acres. The evidence we provided you for your consideration included high
resolution photographs documenting each code violation.
In the three minutes that is allowed for public comments we briefed you as best we
could on the extent of our findings and asked you to direct your staff to
conduct an immediate "on the ground" inspection.
25 days have elapsed and we still don't know what the County has done or intends
to do. We don't know if one or more of you have been calling daily for updates or
if the evidence file is sitting on someone's desk or if it has been recycled.
We do not know if the County has made any effort to verify the extent of this
developer's rooting around at Tarboo Lake with men and machinery. We don't
know why he is allowed to begin construction without any environmental review
and with no permits.
We like our community. We like our government. We like you and respect the
job you do, and the people you have working for you. You have an enormous
task and nowhere near enough resources. At this juncture, Jefferson County has
no code enforcement. DCD currently has 212 complaints it is not processing.
DCD is short staffed. It has no one to send out for inspections. A stop work
order has not been issued in Jefferson County for over six years. It is not clear
that any staff member even knows the procedure to issue a stop work order.
Please, fund vigorous code enforcement resources in the 2019 budget now under
consideration so, instead of just being able to ask questions, we can also get some
answers.
