THE NATURE OF THE ADJUSTMENT IS DESCRIBED AS FOLLOWS: -standing This BLA is designed and intended to resolve a long s Boundary Line Adjustment - 1 boundary dispute and encroachment, by mutual agreement, after several years of litigation described below. shed and In the late 1970's, the Coulters built a garage, fence encroaching onto the northerly portions of Lots 47 and 48, Tamarack Village. Adverse possession/quiet title litigation followed, between Grantor Minnihan and Grantees Coulter, in Jefferson County Superior Court #84-2-00063-4. et title to Minnihan Judgment was entered in 1991 giving quiet in ownership of the area of encroachment, and an easement of continued use of the.encroachment area to the Coulters until June 2001 when their structures must be removed from.Lots 47/48. .In two subsequent litigations, Minnihan v. Camfield, JeffCo #93-2-00144-3, and Barnhouse V. Minnihan, JeffCo #95-2-002530, adjacent areas of the Northerly portions of Lots 47 and 48, both the East and West of the Coulter area of encroachment, were conveyed to those neighbors by quiet title judgments. See map attached. The remaining area of encroachment onto Lots 47 and 48 by the Coulter's structures, 241x1001, while valuable to them if they can avoid removing their useful structures in 2001, is left of little value to Lots 47 and 48 because of the remaining shape and configuration of those lots, after loss of the adjacent areas to Camfield and Barnhouse. Neither Lot 47 nor 48 would now total 12,500 square feet even including the area to be conveyed by the BLA. The parties wish to peacefully and agreeably end their boundary dispute and avoid further litigation over the disputed area, by this BLA and accompanying Quitclaim Deed. STATEMENT .OF INTENT: This recording is for the purpose of assisting with a boundary line adjustment pursuant to RCW 58.17.040(6).. It does not create any additional lots, tracts, parcels or division as the land described herein shall merge or be integrated into abutting property presently owned by the proponent. Nor does the boundary line adjustment result in any lots, tracts, parcels or division which contain insufficient area and dimension to meet minimum County and sanitation requirements for width and area for a building site.
