SUBJECT: Community Development Fee Policy, Refund Policy, and Proposed
Modifications to Community Development's Fee Schedule
STATEMENT OF ISSUE:
Jefferson County's Department of Community Development(Community Development), an
enterprise fund, proposes modifications to its fee schedule adding new services and reviews, modifying
existing services and reviews, deleting repealed services and reviews, and increasing its hourly review fee.
Community Development proposes fee and refund policies establishing policies related to the collection,
use, and refund of fees.
ANALYSIS:
A February 11,2019 public hearing is proposed on Community Development's fee schedule including
a proposed Hearing Examiner fee; however, Community Development's proposed Fee and Refund
policies are not part of the February 11,2019 public hearing. The Fee and Refund policies included
with this memorandum are for Board of County Commissioners feedback only.
Proposed Modifications to the Fee Schedule
In 2018,the Jefferson County Board of Commissioners (BoCC)made substantial legislative changes
to its Code, including changes to Title 8 and Title 18, warranting modifications to the Community
Development fee schedule, which expressly lists the various types of applications and reviews performed by
the Department. Community Development is an enterprise fund requiring that the Department capture its
permit and application costs through fees, such as application and review fees for land use and building
permits. The proposed modifications to the fee schedule include updates to match recent legislative changes,
modifications based upon applications and services rendered by the Department, and an increase in the
overall hourly fee from $92 to $94 based on the 2018 Consumer Price Index (CPI) (rounded to the nearest
dollar). Below is an overview of the proposed modifications.
• Increase in hourly fee from $92 to $94 (based on CPI and rounded to the nearest dollar)

• Addition of the following services and reviews
o Boundary Line Agreement(4 hour base fee);
o Lot Certification(4 hour base fee);
o Hearing Examiner Fee ($1,250 per Type III application or appeal requiring adjudication by
the Hearing Examiner);
o Miscellaneous Hourly Fee ($94 per hour charged for services and reviews not expressly listed
within the fee schedule);
o Commercial Shooting Facility Ordinance—Operating Permit(23 hours base fee. Chapter
8.50 of the Jefferson County Code); and
o Built without permits (BWOP)penalty fee (50%penalty based on total permit fee)
• Modification of the following services and reviews
o Waiver of Special Reports (increased to 3 hour base fee from 2 hours)
• Deletion of the following services and reviews
o Site Plan Approval Advanced Determination
Hearing Examiner Fee
Community Development seeks direction on the payment of the Hearing Examiner fee. Currently, the
Hearing Examiner, which adjudicates Type III applications and land use decision appeals as quasi-judicial is
paid for by the County General Fund as a non-departmental line item.
Washington counties are split on applicant payment of Hearing Examiner fees with a majority passing
the cost of the permit or appeal decision along to the applicant and the minority paying for the cost out of
their general fund or another appropriate revenue source. For example, Clallam and Kitsap counties charge
$800 for applications and appeals requiring the Hearing Examiner in addition to their base application fee
and other fees. Mason County charges $2,330 for applications and appeals requiring the Hearing Examiner
in addition to their base application fee and other fees.
As Community Development is an enterprise fund, it is recommend that applicants bear the cost of
their permit, application, or appeal adjudication for Type III permits and appeal decisions made by the
Hearing Examiner. In 2018, our average cost per Type III decisions was $1,258. Community Development
proposes a$1,250 Hearing Examiner fee for all Type III applications and appeals, in addition to Community
Development fees, such as our base hourly fee, public hearing notice fee, and notice board fee. This solution
provides a system in which the applicant pays their fair share of permit or application adjudication and is
consistent with the majority of Washington counties.
Built Without Permit(BWOP) Penalty Fee
Community Development seeks direction on the implementation of a Built Without Permit(BWOP)
penalty fee. Currently,there is no penalty fee assessed for structures built without permits. As proposed, a
50%penalty fee will be assessed in addition to the base building permit fee. The BWOP penalty fee serves
as a financial disincentive to building without permits. Community Development receives several hundred
code enforcement complaints annually, many of which allege unpermitted structures. In addition to serving
as a financial disincentive, the BWOP penalty fee will be used as a tool in Community Development's
upcoming code compliance program. Community Development has completed a comparative analysis of
surrounding jurisdictions and the proposed fee and program is consistent with surrounding jurisdictions.

The attached Fee Policy provides the Community Development Director with the discretion to waive
the BWOP penalty fee, including in circumstances when the BWOP was not the applicant's or their agent's
fault or the applicant purchased the property within the past 6 months.
DCD Fee and Refund Policy
Community Development seeks direction on its proposed Fee and Refund Policies. These policies
formalize longstanding DCD fee and refund policies into concise documents providing customers advance
notice of fee and refund handling procedures. The proposed policies are generally consistent with surrounding
jurisdictions.
A February 11,2019 public hearing is proposed on Community Development's fee schedule
including a proposed Hearing Examiner fee; however, Community Development's proposed Fee and
Refund policies are not part of the February 11,2019 public hearing. The Fee and Refund policies
included with this memorandum are for Board of County Commissioners feedback only.

FISCAL IMPACT:
The proposed modifications to Community Development's fee schedule have a positive impact on the
County's General Fund, as the Department will better capture its permit and application fee revenue based
on recent legislative changes, modifications based upon applications and services rendered by the
Department, and an increase in the hourly rate charged by the Department from $92 to $94 per hour.
The proposed fee modification for the Hearing Examiner is expected to save the County's General
Fund non-departmental line item account approximately $15,000 per year or$1,250 per Type III decision or
appeal rendered by the Hearing Examiner.
RECOMMENDATION:
Community Development recommends holding a public hearing on the proposed modifications to the
Department's fee schedule on Monday, February 11, 2019 at 10:00am. The Department recommends
approving the attached Hearing Notice.

MODIFICATIONS FOR THE JEFFERSON COUNTY } ORDINANCE NO.
DEPARTMENT OF COMMUNITY DEVELOPMENT }
WHEREAS, this Ordinance sets a new fee schedule for the Jefferson County Department of
Community Development("Community Development"); and
WHEREAS, Community Development is primarily an enterprise fund providing services to the
public for a fee, such as land use and building permits; and
WHEREAS, Community Development annually reviews its hourly rate for staff review activities
by analyzing its costs, including administration and overhead for fee related activities, and the billable
hours of staff assigned to fee work; and
WHEREAS, Community Development annually reviews its base hours for staff review activities
by analyzing level of effort for reviews and services;and
WHEREAS, Community Development updates their fee schedule providing for an increase to
their hourly review rate,establishes base hours and fees for newly enacted reviews, deleting repealed
reviews, and providing for flexibility in miscellaneous reviews or services; and
WHEREAS, on February 11, 2019,the Jefferson County Board of Commissioners("BoCC")held
a public hearing soliciting input and feedback on the proposed fee schedule.
NOW THEREFORE,BE IT HEREBY ORDAINED, by the Jefferson County Board of
Commissioners as follows:
Section 1.Findings. The BoCC hereby adopts the recitals(the WHEREAS statements)as its findings of
fact in support of this Ordinance.
Section 2. Appendix A. The BoCC adopts Appendix A establishing an updated fee schedule as Jefferson
County Code Appendix, Fee Schedule, II. Department of Community Development—Building Division,
Development Review and Long-Range Planning.
Section 3. Repeal. This Ordinance repeals and replaces all Ordinances relating to Community
Development's Fee Schedule, including Ordinance No. 08 1123 15.
Section 4. Severability. If any section, subsection, sentence,clause,phrase or section of this Ordinance or
its application to any person or circumstance is held invalid,the remainder of this Ordinance or its
application to other persons or circumstances shall be fully valid and shall not be affected.
Section 5. Effective Date. The Ordinance becomes effective upon adoption by the BoCC.

NOTICE IS HEREBY GIVEN that the Jefferson County Board of County Commissioners will hold a
public hearing on Monday, February 11, 2019 at 10:00 AM in the Board Chambers at the Jefferson
County Courthouse, 1820 Jefferson Street, Port Townsend, WA 98368, to consider proposed
amendments to the Fee Appendix of the Jefferson County Code, to revise the hourly rate for the
Department of Community Development, add additional services and reviews, and delete repealed
services and reviews. Following the public hearing, the Board may take formal action on the proposed
amendments.

FEE POLICY
Background
The Department of Community Development (DCD) is primarily an enterprise fund.
Generally, DCD provides services to the public for a fee, such as land use and
building permits. DCD's limited general fund supports non-proprietary fund activities,
such as non-permit administrative time and certain long-range planning tasks.
Fees assessed and collected beginning March 1, 2019 shall adhere to the guiding
principles and fee policies as established by the DCD and approved by the

Guiding Principles
➢ Fees should be regionally competitive while allowing for timely, high-quality
service delivery by staff.
➢ Fees should be predictable and understandable to the customer.
➢ Fee based services are defined as operations related to permit/application
processing, inspections, plan reviews, State Environmental Policy Act
documents, land use appeals, and code enforcement.
➢ Applicants pay for the services received.
➢ Fees shall include direct and indirect costs associated with service delivery.
➢ The funding structure should support the Department's operations through
economic cycles and fluctuations in workload.
➢ The fee system should be efficient and cost-effective to manage.
Fee Policies
Policy 1: DCD establishes a cost recovery objective model for service delivery
to the applicant. The cost recovery objectives of the model are approved by the
Board of Commissioners.
Policy 2: Fees are be based on an hourly rate to review and process
applications, such as pre-applications, environmental reviews, and land use
applications. Inspections associated with these application types are charged at
an hourly rate. The hourly rate includes applicable travel time. No applicant will
be charged additional hours or credited with hours without a review by the
appropriate manager to ensure the increase/reduction is valid.

Policy 3: Permits, plans reviews, and inspections subject to the international
building code will be assessed a fee based on valuation tables and
methodologies established by the International Building Code Committee.
Increases in building permit fees will occur bi-annually based on the February and
August publication of valuation fees by the International Building Code
Committee. The determination of Jefferson County's valuation factor will be
consistent with the methodology established by the International Building Code
Committee.
Policy 4: Permit fees associated with major component systems (e.g. heat
pump) of a structure will be charged as follows: Commercial structures will be
based on the valuation of the system being installed. For example, a plumbing
system would be assessed at the value of the total system versus charging by
individual components. Residential structures will be assessed on a per unit
basis.
Policy 5: Applicants or individuals shall pay for the hearing examiner's services.
Applicants or individuals making appeals to the hearing examiner shall pay the
fee as established in the current fee schedule.
Policy 6: Fees will recover indirect costs associated with the permit process.
Indirect costs are defined as the following: administrative costs; personnel
support costs; training and public education costs; technology costs; and,
facilities costs. Other indirect costs may be identified in the future and may be
charged in the fee structure provided they are associated with the permit process
and linkage can be clearly identified.
Policy 7: Indirect costs will be calculated on a ratio of personnel supported. For
example, if 80 percent of the Department's line staff is involved with the
permitting, review, and inspection processes, then 80 percent of the
Department's indirect costs will be charged to fees.
Policy 8: The Department of Community Development (DCD) Fund 143000010
establishes criteria for financial liabilities and reserves financed by permit and
application fees. The Department has an obligation to report the status of the DCD
Fund Balance to the Board of County Commissioners.
Policy 9: Each fee covers the cost of intake, plans review, and inspections. Fees
are based on two iterations of plans review (first submittal comments and review
of second submittal comments) and two iterations of inspections (initial inspection
and follow up inspection). When a plan review or inspection is required a third or
more times, the applicant will be required to pay the hourly rate for review and
subsequent inspections.

Policy 10: Other county departments who utilize the Department of Community
Development will pay the appropriate fees per the fee schedule with the
exception of Public Works Road Fund projects.
Policy 11: Contingent on availability of staff, applicants may seek an expedited
review or inspection provided they are willing to pay for the additional costs, either
with an outside agency review or overtime.
Policy 12: Fee refunds, exemptions, and credits shall comply with DCD's Fee
Refund Policy, as approved by the Jefferson County Board of Commissioners.
Policy 13: Fees are due and payable at the time services are requested unless
otherwise specified in the established fee schedule and policies. Failure to pay
established fees may result in one or more of the following:
• No additional inspections, including final inspections, will be scheduled or
performed until all outstanding fees are paid.
• No Temporary or Final Certificate of Occupancy will be approved or
issued for a project with any outstanding fees on any permit associated
with the project. Exceptions may be authorized by the Building Official or
Director only.
• An approved or issued permit may be revoked for non-payment of fees.
• Any outstanding fees will be collected by Community Development using
available collection methods, consistent with all local, state, and
applicable federal laws or regulations.
Policy 14: The Community Development Director may waive Community
Development fees at their sole discretion.
Policy 15: The Board of County Commissioners may waive Community
Development application, review, or miscellaneous fees at their sole discretion.
Policy 16: If a Built Without Permits (BWOP) penalty fee is assessed, the
Community Development Director may waive the penalty fee at their discretion,
including circumstances where the BWOP was not the applicant's or their agent's
fault or the applicant purchased the property within the past six (6) months.

REFUND POLICY
The Department of Community Development Director is responsible for establishing fee
and refund policies, consistent with applicable local and state laws, regulations, and
policies.
Authority: 18.05.040 Jefferson County Code. Department of Community
Development— Duties and responsibilities. Duties and responsibilities of the
director.
Policy:
A. All fee refunds shall be authorized by the Jefferson County Department of
Community Development Director (DCD Director) or their designee.
B. Refund amounts will be determined by the amount of work completed
by the Department of Community Development, not to exceed 80% of
the initial fee.
C. Refund requests must be received within one year of the original
payment date.
D. Refund requests can only be processed on applications or active permits.
Refunds will not be granted for expired, cancelled, or abandoned permits.
E. Refunds shall be issued within 60 calendar days of the refund
request date, once authorized.
F. Refunds shall only be issued to the original 'payee'. If property is sold
or transferred the fees are forfeited.
G. The following items shall not be eligible for refund:
• Fees previously collected for expired permits or applications;
• Fees expended to satisfy public notification requirements;
• Fees associated with expended staff hours for application
review notification, processing or inspection;
• Hearing examiner fees once the hearing has been conducted;
• State Building Code Council surcharges;
• Fees or actions expressly prohibiting refunds under local or state laws,
regulations, or policies; and
• Fees on approved or issued land use permits.
Credits for canceled building permits when a new building permit is
received.

2. If the application for a new building permit does not exceed the approved
building footprint then no new land use or septic environmental health review
are typically required or charged; however in all cases:
a. A new water review and plan check review fee will be charged on the
new application.
b. The building base fee from the canceled permit will be credited at
90% and transferred to the new permit if:
i. If the applicant is the original applicant.
ii. No inspections or building review have been performed.
c. Fees for the new permit will be charged at current rates.
d. The permit that is being cancelled is not more than two years old.
