Staff Testimony on Long Haul Contract
Please add to the Hearing Record the following Staff Testimony on the proposed Long Haul Contract:
• p. 3 paragraph 2: "...Facilities to accept Loaded Waste at the Jacob Miller Transfer Station...." Best to read "...from
the Jacob Miller Transfer Station ..." However when I first spoke with Tom Boatman about this, I hadn't yet read
that "Facilities" is a defined term referencing the Disposal Site. So this change would be nice, but is not required.
• p. 13 Section 6.6(b)(2): to avoid violation of WA Public Records Act, add highlighted language as
shown: "...'confidential business records' means all trade secrets, proprietary plans, financial data and the ideas and
information contained therein, that Contractor designates to the County as confidential and makes available to the
County for purposes of this Contract."
• p. 15 Section 6.12(a): requires Contractor to notify County of any qualifying accidents within seven days. Perhaps
we also want to require 24 hour notice for any qualifying accidents that take place in Jefferson County? This will
better allow us to collect evidence related to the accident and liability, if needed.
• p. 17 Article 7: Who picks up waste at the Quilcene Drop Station? Does Republic, or does County haul it to Jacob
Miller? Do we need to specify that?
• p. 27 Section 12.3(a)(11): "Pollution Liability (same as Marine Operations, see Section 12.4)." But Section 12.4 is
Workers Compensation. Please fix Pollution Liability text.
• Add "closure and post -closure" before the words "trust fund" in Section 6.10(b), so there is consistent usage of
terms in Section 6.10.
• Consider adding definitions for Contractor's Certificate (2nd Recital, p. 3), County Representative (Section 2.12),
Contractor's Representative (Section 2.12)—all are capitalized terms in the Contract, but are not defined.
• Consider deleting ", its successors or assigns" from the definition of County. There is no parallel addition to the
definition of Contractor and this is covered generally in Section 18.4.
• Consider changing to lower case the word "Party' in the definition of Execution Date or Date of
Execution. "Party" is not a defined term.
• Consider changing to lower case the word "Representative" (twice) in Section 5.1. "Representative" (alone) is
not a defined term.
• Consider deleting the space in "post- closure" in Section 6.11(1).
• Consider adding a comma between the words "Contract" and "except" in Section 7.7(d).
• Consider adding a comma between the words "Section" and "the County" in Section 9.3(e).
• Consider deleting a space between the words "under Section 18.3" in Section 16.1(b)(3).
• Consider deleting the underlining in the space after "... County Savings. If ..."
