Description of Proposal: Proponents wish to develop an animal sanctuary for horses and possibly other
large animals. The facility will use existing structures and pastures. Estimated population of about 50
animals maximum. The facility will use existing water supply (Gardiner LUD#1) and septic facilities.
Access: This will be a private facility with no public access. Current access is through existing paved
driveway on east side of site, Parcel #002344002. The access is proposed to be changed via Gardiner
Cemetery Road through Parcel #002343001, using road easement.
Land Use JCC 18.15.040: Animal Shelter, C(d) in RR1:20
“Animal shelter” means a facility which is used to house or contain stray, homeless, abandoned or
unwanted animals. Shelters are owned, operated or maintained by a public body, established humane
society, animal welfare society, society for the prevention of cruelty to animals or other nonprofit
organization devoted to the welfare, protection and humane treatment of animals. Shelters also include
facilities for the rehabilitation of wildlife.
Contrast with Equestrian Center:
“Equestrian center” means uncovered and covered facilities for commercial boarding, training, teaching,
breeding and rental of horses including facilities for shows and competitive events, and riding trails. This

shall not include stables used solely for the private personal use of the property owner or stables used
solely for boarding or breeding of horses.
Chapter 18.22 JCC Critical Areas:
Fish-Bearing Stream
Protection Standards JCC 18.22.270. 150-foot protective buffer, measured horizontally on both sides of
the stream from ordinary high water mark. An additional 5-foot building setback is required from the
buffer, if applicable. Buffers shall be retained in their natural condition; however, minor pruning of vegetation
to enhance views or provide access may be permitted as long as the function and character of the buffer are
not diminished.
Chapter 6.07 JCC Animal Control.
6.07.120 Nuisance noise. Exceptions. (b) Lawfully operated animal shelters, animal welfare facilities, pet
shops, or veterinary clinics shall be exempt from this section, and commercial kennels which have
received a land use permit pursuant to JCC 18.20.060, or which were established before January 16,
2001, as legal nonconforming uses, shall also be exempt from this section.
Article VIII. 18.40.490 Conditional Uses.
Conditional (discretionary) Use Permit
Based on the administrator’s discretion, the permit may be processed administratively as a Type II
decision, or as a Type III decision by a Hearing Examiner.
Conditional Use Permit Steps
1. Application submitted by applicant (see Conditional Use Permit form)
2. Notice of Type II application – Notice in Leader, posted on site and mailed to adjacent property
owners within 300 feet.
3. 14-day public and agency comment period
4. Staff reviews the comments, application materials and requests any additional information needed
to meet the county codes. Staff may also request the applicant review the public and agency
comments and address any concerns.
5. Staff Report: staff enters findings, conclusions and recommendation for permit decision
6. Appeal Period (14 days). Appeal to Hearing Examiner for open record hearing.
7. The conditional use runs with the land on the area specified.

Assurances are unavailable. Discussions at the Pre-Application Conference are not binding, and no statement
made by county representatives shall in any way relieve applicant of the duty to submit an application consistent
with all relevant regulations and requirements. Pre-Application Conferences do not vest any portion of the
development proposal. The burden is on the applicant to read, understand, and verify applicable statutes,
regulations, and rules.
