SUBJECT: AGREEMENT, Amendment No. 5 re: Jefferson County Comprehensive
Plan; No Dollar Change, Extension of Time Only; Jefferson County
Community Development; BERK Consulting, Inc.
STATEMENT OF ISSUE:
The agreement for Jefferson County Comprehensive Plan services with BERK Consulting, Inc. will expire
on March 31, 2019. It is determined that an additional 60 days is needed to complete this service.
ANALYSIS:
On February 5, 2018, the County Commissioners approved an agreement with BERK Consulting, Inc. to
conduct the Jefferson County Comprehensive Plan Periodic review. The original agreement was amended as
follows:
Supplemental Agreement #1 executed on July 23, 2018
Supplemental Agreement #2 executed on September 26, 2018
Supplemental Agreement #3 executed on October 29, 2018
Supplemental Agreement #4 executed on December 17, 2018
Supplemental agreement #4 expires on March 31, 2019. BERK Consulting, Inc. has not completed their
review. The proposed amendment #5 extends the agreement until May 31, 2019.
FISCAL IMPACT:
This amendment does not change the dollar amount. It is an extension of time only.
RECOMMENDATION:
The Commissioners are being asked to approve amendment #5 with BERK Consulting, Inc. extending the
agreement through May 31, 2019.

The Local Agency of Jefferson County desires to supplement the agreement entered into
with BERK Consultants, Inc. and executed on February 5, 2018 and
identified as Agreement No. Professional Services Contract for Comprehensive Plan Periodic Review
All provisions in the basic Professional Services Contract, dated February 5, 2018, as amended by
Supplemental Agreement #1 executed on July 23, 2018; and Supplemental Agreement #2 executed on
September 26, 2018; and Supplemental Agreement #3 executed on October 29, 2018; and Supplemental
Agreement #4 executed on December 17, 2018, remain in effect except as expressly modified by this
supplement.
The changes to the agreement are described as follows:
Section 3. Time for Performance, is hereby changed to read as follows:
Work under this contract shall commence upon the -giving of written notice by the County to the
Consultant to proceed. Consultant receipt of a Purchase Order shall constitute said notice. "Consultant
shall perform all services and provide all work product required pursuant to this agreement to a date not to
exceed May 31, 2019."
