Good morning Shannen,
As we discussed on the phone the scale of the harvest area shown on the Forest Practice Activity Map for FPA/N
2675L92 is actually fairly accurate for the actual parcel size of 10 acres. The acreage was only reported inaccurately in
question 21. as 4.5 acres. I conducted a site visit on February 22,2OL8 and observed that approximately 9 acres of the L0
acre parcel was harvested. The l- acre area not harvested is also accurately depicted in the southwest corner on the
Forest Practice Activity Map.
Please let me know if you need further clarification.

Hi Shannon,
Sorry for the delayed response. I did meet with someone out there a little over a year ago. lt may have been one of the
new landowners, but it had not been purchased yet. I did observe that the whole parcel except for approximately one
acre in the SW corner had been harvested. Therefore the moratorium would apply to all the property except for the
approximately one acre of un-harvested area.
I don't remember definitively telling the landowner I was going to take enforcement action - but it was an option. I may
not have in this case for a couple of reasons. The first is because there was no resource damage associated with the
harvest. I verified that the stream shown on the hydrology layer did not exist. Additionally the additional acreage would
not have changed the classification or complexity of our permit. The second is because the person I met with seemed
pretty interested in purchasing the parcel. From prior experience, an enforcement action may have had negative
unintended consequences for the new landowner in terms of the permitting process with Jefferson County.

Hi Ross,
I met with the new owners of parcel #001334021. The county has put a moratorium on the property for the area
proposed to be logged. I believe it was supposed to be 4.5 acres. However, when I met with the owners, they stated
almost the entire 10.31 acre parcel had been cleared by Cedarland Forest Resources. They stated they had spoken with
you and you had allegedly said enforcement action will be taking place because the applicant cleared more than the FPA
allotted. ls this accurate information? Mainly I need to know, to confirm that the moratorium needs to be applied to the
entire property.

Continuino Forest Land Obliqations IRCW 76.09.050. RCW 76.09.070. RCW 76.09.390. and WAC 222-20-0551
Obligations include reforestation, road maintenance and abandonment plans, conversions of forest land to non-
forestry use and/or harvest strategies on perennial non-fish habitat (Type Np)waters in Eastern Washington.
Before the sale or transfer of land or perpetual timber rights subject to continuing forest land obligations, the seller
must notify the buyer of such an obligation on a form titled 'Notice of Continuing Forest Land Obligation". The seller
and buyer must both sign the'Notice of Continuing Forest Land Obligation" form and send it to the DNR Region
Office for retention. This form is available at DNR region offices.
lf the seller fails to notify the buyer about the continuing forest land obligation, the seller must pay the buyer's costs
related to continuing forest land obligations, including all legal costs and reasonable attorneys'fees incurred by the
buyer in enforcing the continuing forest land obligation against the seller.
Failure by the seller to send the required notice to the DNR at the time of sale will be prima facie evidence in an
action by the buyer against the seller for costs related to the continuing forest land obligation prior to sale.
