This approval is good only as long as the applicant continues to reside on the property, retain an ownership interest in the business and remain an employee of the business; or, the applicant sells the business together with the residence and the remaining portion of the property to an owner who will reside on the property, have an ownership interest in the business and be an employee of the business.2.) The Home Business shall be clearly incidental and secondary to the use of the propefi for residential purposes.3.) The Home Business shall be conducted in the principle dwelling unit or accessory structure, except for outdoor activities related to the growing and storing of plants or other incidental outdoor activity related to the home business.4.) The area devoted to the home business shall not exceed fifty percent (50%) of the gross floor area of the dwelling unit, or 1,200 square feet, whichever is greater. The home business may be located in an attached or detached structure, but in no case shall be allowed to expand beyond this permitted size.5.) The business must be owned and operated only by fulltime residents of the parcel on which the proposed use is being requested. The home business may not have employees other than those of the immediate resident family without additional septic review per Environmental Public Health Department.6.) The Home Business shall have neither outside storage nor other exterior indication of the home business or variation from the residential character of the property.7.) Retail sales are limited to products and services produced on the subject premises or items accessory to a service (e.9. hair care products for beauty salon).8.) Noise levels generated shall not be in excess of levels allowable in residential neighborhoods as per Chapter 173-60 Washington Administrative Code as adopted by Jefferson County Resolution No. 67-85 and Ordinance 02-0209-15.9.) Home-based businesses shall be limited in their hours of operation. No home business, except for Bed and Breakfast operations and licensed family home day care providers, shall be conducted before 8:00 a.m. or after 8:00 p.m., Monday through Friday, and before 9:00 a.m. or after 6:00 p.m., Saturday and Sunday. 10 ) The proposed use shall not generate significant traffic in excess of that normally generated by typical uses found within the particular district. 11 ) No more than one sign is allowed, consistent with the sign standards in 18.30.150 of the Unified Development Code.12.) All parking for the home business shall be located on-site in such a manner that no off-premise parking will be necessary. Parking shall be consistent with the development standards found in 18.30.100 of the Unified Development Code. 13 ) Exterior lighting shall not exceed twenty (20) feet in height from the finished grade. Exterior lighting shall be energy efficient and shielded or recessed so that direct glare and reflections are contained within the boundaries of the parcel. Exterior lighting shall be directed downward and away from adjoining properties and public rights-of-way. No lighting shall blink, flash, or be of unusually high intensity, and height to the use they are serving. Any lighting installed in parking areas shall be of direct cutoff design so that the source is not visible from adjacent property. 14 ) Home businesses shall not be unreasonably disruptive to the use of adjacent properties. No equipment or process shall be used in a home-based business which creates excessive noise, vibration, glare, fumes, odors, or electrical interference to the detriment of the quiet use and enjoyment of adjacent and surrounding property. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other applicable ordinances and regulations, and is consistent with the Jefferson County Comprehensive Plan and Land Use map.2.) The Geographic lnformation Systems mapping review identified [and/or a srte inspection confirmed] the following CriticalAreas on the subject property: Critical Aquifer Recharge Area--Susceptible Aquifer (SUSC).3.) Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers.4.) Jefferson County has determined that the use of real proper$ for agriculture and forestry operations is a high priority and favored use in the county. The county will not consider to be a nuisance those inconveniences or discomforts arising from such operations, if such operations are consistent with commonly accepted best management practices in compliance with local, state, and federal laws. lf your real property includes or is within five hundred (500)feet of real propefi designated as Rural Residential 1:10 or 1:20, Rural lndustrial, Rural Commercial, Agriculture, or Forestry, you may be subject to inconveniences or discomforts arising from such farming and forestry operations, including but not limited to noise, tree removal, odors, flies, fumes, dust, smoke, the operation of farm and forestry machinery during any 24-hour period, the storage and disposal of manure, and the application of permitted fertilizers and permitted pesticides. One or more of these inconveniences may occur as a result of agricultural and forestry operations which are in conformance with existing laws and regulations.5.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental PolicyAct (SEPA) pursuant to WAC 197-11-800.6.) This approval is for a Home Business only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits.7.) The parcel has been designated as Rural Residential 1:5 under the Jefferson County Comprehensive Land Use Map effective August 28, 1998.8.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. lf during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8,2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that "takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). ln addition, the National Marine Fisheries Service can levy penalties. Portions of Jefferson County, including marine environments are included as "critical habitat" for listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: - All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees - Allow trees that have fallen into surface waters to remain there - lnfiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet ('1l8th of a mile) of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from "taking" bald eagles. This federal law defines the term "take" and describes the possible legal consequences when a "take" occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and Wildlife Service (http://www.fws.gov/pacific/eagle/) to learn more about how this law affects your project. Any individual, group, or agency can bring suit for a listed species "taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and Wildlife Service. APPEALS: Pursuant to RCW 36.70C, the applicant or any aggrieved party may appeal this final decision to Jefferson County Superior Court within twenty-one (21) calendar days of the date of issuance of this land use decision.
