The consultation includes preliminary review and administrative assistance. This service does not include extensive field inspection or correspondence. Pre -application consultation does not limit subsequent administrative review. At the conference, Department of Community development personnel shall provide the applicant with: (1) A list of the requirements for a completed application; (2) A general summary of the procedures to be used to process the application; (3) The references to relevant code provisions or development standards that may apply to the approval of the application; and (4) A list of any applicable hourly review fees that may be charged by one or more County agencies upon the filing of a project permit application with the County. Discussions at the conference or the information provided by the staff shall not bind or prohibit the County's future application or enforcement of all applicable laws and regulations. The application was incomplete. You must submit the additional information noted below to allow further processing of your application. After speaking with the Forest Service, it is my understanding that the scope of work falls outside of their jurisdiction, and that the role of Lead agency may belong to the county. There has been a Special Use Permit in place since 1982 (minus the years it was expired, due to FS lack of staff), and in this time the permit was in good standing with no compliance related issues according that I could find. It has an FERC exemption. Only one time over the course of 32 years was there any issue raised about our compliance with any state or federal obligations and that occurred in 1997 with an operator who is deceased. The project has a minimum flow obligation and we are not seeking to modify of alter that obligation. This is, however, a very old facility and it is a genuine run of the river project. When it was established the discharge for the plant was located upstream of the plant approximately 200'. That was not done to provide minimum flows which are diverted at the top of the intake and the balance of the water in the stream comes from the Rocky Brook water falls itself. The outflow should have been established adjacent to the power house because when it is upstream there is a flooding issue if the plant has to shut down. In addition to the flood problem a pelton, which is the -appropriate turbine for smooth operations, requires a straight discharge and that is the equipment we would like to utilize moving forward. It is impossible to operate efficeintly with an antiquated pump turbine system and a pelton has the added benefit of a smoother discharge stream. We are seeking permission to move our discharge downstream 200 feet and will not need to operate in the water to do so. We will put a new fish screen in place. This is a pretty straignt forward request and we have already checked with the Forestry people and they have no objection.
