Dear Mr. White:
This letter is to inform you that Jefferson County Public Health (JCPH) intends to file a Notice to
Title on your property for failure to comply with the Jefferson County Onsite Sewage Code 8.15.
The following is a brief summary of the actions that JCPH has taken to achieve compliance:
08/02/2004 JCPH investigated surfacing sewage report
09/23/2004 JCPH received a repair permit from Mike Deeney
10/07/2005 JCPH Notice to Title for monitoring and maintenance contract requested
10/20/2006 JCPH Again requested NTT for monitoring and maintenance contract
In 2004 an investigation was completed on the above septic system. It was noted at that time that
there appeared to be stream of discharge coming out of the bank and draining on the beach. We
discussed the steps you would need to take to repair your septic system. You applied for a permit in
September of that year and to date the system remains in a status of"incomplete".
If the onsite sewage code violations are not corrected by December 28,2015 we will proceed with
the recording of the Notice to Title in the Jefferson County Auditor records.The Notice to Title will
describe the existing violations of the County's onsite sewage code present at your parcel.
In order to remove the Notice to Title,you must obtain a permit to complete the required
corrections and document that you have corrected the violations and pay the Notice to Title fee per
the fee schedule at the time of correction, currently set at$525.00.

Project Description: AEROBIC UNIT/PRESSURE BED
A review of the above referenced file indicates that the following items must be completed before final approval
can be given:
❑ The file indicates that an inspection of the drainfield and other components was completed but the septic
tank(and pump chamber if required)was not yet installed. This permit is being placed in an incomplete status.
Prior to approval of any building permit on the site you will need to reapply for a sewage disposal permit for the
tank(s)only and pay the applicable fees required at that time
❑ Corrections as specified by the designer.
0 Submit a record drawing and certification of completion by your designer.
❑ All systems require a monitoring agreement be recorded to the property title.As of this date,this office has
not received a recorded copy of the agreement to monitor the system.Actual monitoring of the system will
not begin until the system is in use(a building or facility with plumbing is connected).The agreement and
instructions for recording are enclosed.
❑ Protective Barriers are required around the tanks, primary and reserve drainfield areas to protect from parking,
driving and other land disturbing activities.

Other Contract with Certified Operations and Maintenance provider for FAST Aerobic Treatment Unit
This system is not considered complete and a final inspection and certificate of occupancy for a building
containing plumbing cannot be issued until the onsite sewage disposal permit is final. Occupancy would be a
violation of Jefferson County Code 8.15, Washington State Code 246-272A and the Jefferson County
Building Code.

the date of this letter to verify the status of the checked items or if you have further questions.

THIS AGREEMENT is made this date by and between CALVIN MAR WHITE and LINDA
LEE WHITE,his/her heirs and assigns("GRANTOR(S)")and Jefferson County Public Health("GRANTEE")
WHEREAS, CALVIN MAR WHITE and LINDA LEE WHITE
is/are the owner/s of a certain tract of land particularly described as follows:
PARCEL NO. WHERE SEPTIC SYSTEM IS LOCATED: Parcel#:983401309
LEGAL DESCRIPTION(S): Section: 23 Township 28N Range 1E
PARADISE BAY ESTATES BLK 13 LOT 11
ADDRESS OF RESIDENCE SERVED(if assigned): 121 SHORE DR
and,
WHEREAS,a sewage collection,treatment and disposal system,as described in case#SEP04-00241 has been installed
thereon,and
WHEREAS,the residence or facility at the above described property,including all parcels associated with said case,utilizes an
onsite sewage system which requires regular maintenance and monitoring for the life of the system. Monitoring is required to
be performed by a person authorized by the Public Health Department,and
WHEREAS,the Owner is required by Jefferson County Public Health Department,as per WAC 246-272A through Jefferson
County Code 8.15 to implement a program for periodic monitoring to assure the continuous and satisfactory operation and
maintenance of the sewage system,and
NOW THEREFORE,in consideration of the premises and the mutual promises and covenants hereafter set forth,the parties
hereto agree as follows:
1. Construction:
a. The Owner has constructed and installed a sewage collection,treatment and disposal system together with
appurtenant facilities whose capacity and design are satisfactory to the Jefferson County Public Health
Department.
b. The plans and specifications for this construction have been approved by the Jefferson County Public
Health Department prior to construction.
c. The sewage system was installed and designed to receive and treat sewage with strength typical of a
residential source.
2. Owners responsibilities:
a. Maintain all components as accessible and unobstructed to the surface including safe access to the
components from the road or right-of-way. Non-accessible or obstructed components will not be serviced and
may result in a violation of permit requirements.

b. Maintain all access risers in a secure manner to minimize injury or unauthorized access.
c. Utilize the system consistent with producing residential waste strength effluent.
d. Operate and maintain the system in accordance with conditions of the permit and Jefferson County Code
8.15.
3. Attachment)Q.111 If box checked this septic system contains a proprietary device that requires
Attachment#1 titled"Notice for Maintenance and Monitoring of a Proprietary Onsite Sewage System Device be
recorded with this document.
4. Schedule:The Owner shall have their sewage system inspected by a person authorized by Jefferson County
Public Health in accordance with the schedule set forth in Jefferson County Code as adopted and hereinafter
amended.For some proprietary products registered with the State Department of Health,the inspector must also be
authorized by the device manufacturer.
5. Reminder:The Jefferson County Public Health Department shall provide a reminder of required monitoring.
The lack of receipt of said reminder does not relieve the property owner from compliance with the monitoring
schedule pursuant to Jefferson County Code.
6. Records:A report of each inspection conducted shall be submitted to the Jefferson County Public Health
Department within 30 days of completion of the inspection.Such records shall be open to the inspection of the
Owner.
7. Hold Harmless:The Grantor shall hold Grantee,its agencies,divisions,officers,agents,and employees
harmless and indemnify them against any liability,damages,judgments,claims or other expenses,including
attorney's fees,that might arise as a result of the negligent acts and omission of the Grantor.
8. Fees:A fee as set forth in the Jefferson County Fee schedule and adopted by the Board of County
Commissioners shall be paid upon submittal of each inspection report.
9. Terms:This agreement shall remain in full force and effect until the date of notification to the Owner by the
Jefferson County Public Health Department that the Owner's Sewer System has been intercepted and connected to
a general sewer system.
10. Amendments:This agreement shall not be modified except with the express written approval of the
Environmental Health Department of Jefferson County.
11. Penalties: Non-compliance with monitoring and inspection requirements is a violation of Jefferson County
Code and shall be subject to enforcement as described in said codes.The County shall have the right to enforce
and compel compliance with this covenant,including all remedies available at law and equity. The County shall
have the right in any such proceeding to recover its attorney fees and costs.
12. Venues:Venue for any action hereunder shall be in Jefferson County,Washington.
13. Severability: If any term or provision of this agreement is in whole or part held invalid or unenforceable
by any court of competent jurisdiction,the remainder of this agreement shall continue in full force and effect.
14. Life of Covenants and Binding Effect:All of the promises,covenants,terms and conditions of this
agreement shall bind the parties to this agreement and the successors and assigns of the respective parties hereto
AND are deemed to run with the land.

The septic system that serves this property utilizes a proprietary device as a component of its on-site
sewage disposal system. This device requires regularly scheduled maintenance and monitoring for the
life of the system. Maintenance is required to be performed by a person authorized by the device
manufacturer. Monitoring is required to be performed by a person authorized by the device
manufacturer and certified by the Health Department as specified in Jefferson County Code,Section
8.15-150 as adopted and hereinafter amended and WAC 246-272A-0270.
